Discharge of Condition 9: In accordance with BS5837:2012 and the arboricultural report; safeguards must be put in place against damage or injury being caused during construction works to any tree, shrub or hedgerow to be retained on the site (as identified in submitted plans). In particular; other than in the submitted arboricultural report, no excavations, site works, trenches or channels shall be cut, or pipes or service laid, or other works carried out in such a way as to cause damage or injury to the trees and hedgerows (by interference with their root structure) and no soil or waste shall be deposited on the land in such a position as to be likely to cause damage or injury to trees. Any tree that dies as a result of the development, or is removed (except those identified in the approved plans for removal) shall be replaced within the first available planting season following such occurrence of trees of a similar size and species.
