1. About these terms

These terms apply to your use of the PlanningTrack website and planning search service. “PlanningTrack”, “we”, “us” and “our” refer to the operator below. Please read these terms before using the service. If you do not agree to them, you should stop using it.

If you use the service on behalf of an organisation, you must have authority to act for it. Our Privacy Policy explains how we handle personal information.

2. What PlanningTrack provides

PlanningTrack brings together planning information from public registers and other planning data sources to help you find applications and explore their history. We are an independent service, not a local planning authority, and do not decide applications or accept official representations on them.

Features and data coverage are developing. Check the data coverage page for the current collection status. Illustrations, example applications and feature previews are demonstrations and should not be treated as live information or a commitment to provide a future feature.

3. Planning data and decisions

Records may be incomplete, delayed, duplicated or inaccurate. Source websites can change, and a stored record may differ from the latest council record. An empty search result does not establish that no application exists. Maps and property matches may be illustrative or approximate.

Check the original planning authority register and relevant documents before acting, especially for consultation deadlines, application status, planning conditions or property decisions. Comments, objections and other formal submissions must be made directly through the authority’s accepted channels.

Our content is general information. It is not professional planning, legal, surveying, financial or property advice. Seek appropriate advice where your decision requires it. Tell us about suspected errors so that we can investigate.

4. Acceptable use

You may use the service for lawful personal or business research, subject to these terms and any rights attached to the underlying data. You must not:

  • Use the service or personal information in it for harassment, fraud, unlawful discrimination or unlawful direct marketing.
  • Attempt unauthorised access, bypass access controls or rate limits, introduce malicious code, or disrupt the service or its providers.
  • Run automated requests that place an unreasonable load on the service or evade technical restrictions.
  • Misrepresent the source, accuracy or official status of information, or imply that PlanningTrack or a council endorses you.
  • Copy or distribute material in a way that infringes privacy, intellectual property rights or applicable licence conditions.

If you need bulk data or an integration, contact us to discuss appropriate access. Public availability does not itself give permission for every use of a person’s information.

5. Content and third-party rights

Our branding, website design, software and original content belong to us or our licensors. These terms permit you to access and use the service; they do not transfer ownership of those materials.

Planning records, drawings, documents and other source material may belong to councils, applicants, architects or other rights holders. We do not claim ownership of their rights or grant you a licence we do not hold. Check the original source’s terms, attribution requirements and any applicable open licence before reusing material.

Links to third-party websites are provided for reference. Those services operate under their own terms, and we are not responsible for their operation or content. Please report a suspected rights infringement with a link to the material and an explanation of your rights.

6. Accounts, alerts and paid plans

Developer accounts provide a free API beta with 500 successful requests per UTC calendar month and a limit of 60 requests per minute, shared across account keys. You are responsible for protecting your keys and for use of data through your integration. There are no automatic overage charges. Alert and paid-plan experiences remain previews; they do not activate alerts or subscriptions or take payment.

If paid services become available, the order process will explain the service, price including applicable taxes, billing period, renewal terms, cancellation process and relevant refund rights before you commit. Any additional terms must be presented before purchase. Preview prices do not create a payment obligation.

Statutory consumer rights, including any applicable cancellation rights, remain unaffected. We will not enrol you in a paid service simply because you explored a preview.

7. Availability and access

We aim to keep PlanningTrack useful and available, but maintenance, source restrictions, technical faults and changes in coverage may interrupt it. We do not promise uninterrupted access or a particular update frequency unless separately agreed for an active service.

We may restrict access where reasonably necessary to address misuse, a security risk or a legal requirement. Where practical, we will explain the reason and allow an opportunity to resolve it. We may change or withdraw free features with reasonable notice where practical. Any commitments for an active paid service and your statutory rights would still apply.

8. Responsibility and liability

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

If you are a consumer, we remain responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill. Nothing here removes your statutory rights.

If you use the service for business purposes, to the extent permitted by law, we are not responsible for indirect or consequential losses, loss of profits, loss of business opportunities or business interruption arising from use of the service. Any separately agreed terms for an active paid service may set out further responsibilities.

The limitations of public planning data described above should be taken into account when using it. They do not excuse a failure to meet obligations that the law places on us.

9. Changes to these terms

We may update these terms to reflect changes in the service or legal requirements. We will show the revised date on this page and give reasonable notice of material changes where practical. Changes will apply going forward and will not remove rights that have already arisen. Changes to an active paid contract would follow that contract and applicable law.

If part of these terms is found unenforceable, the remaining terms continue to apply where possible. A delay in enforcing a term does not waive the right to enforce it later.

10. Contact and disputes

For service questions, complaints or concerns about these terms, use the operator’s contact details in section 1. Please explain the issue and include any relevant page or application reference so we can investigate.

These terms are governed by the law of England and Wales. If you are a consumer, this does not deprive you of mandatory protections under the law of your usual place of residence or any right to bring proceedings in your local courts. Otherwise, the courts of England and Wales have jurisdiction.
