- The extension has commenced which is contrary to paragraphs A.4(2) and A.4(10) of Class A, Part 1, Schedule 2 of the Town & Country Planning (General Permitted development) (England) Order 2015 (as amended). Therefore, the development cannot be considered under permitted development rights.
- Under Article 3(5) of The Town & Country Planning (General Permitted development) (England) Order 2015 (as amended), permitted development rights do not apply where building operations are unlawful. As works commenced without prior approval, the extension is unlawful and therefore cannot be considered under permitted development.
