This application requires biodiversity net gain consideration
The exemption claimed on the application has been reviewed and the proposal is not exempt from biodiversity net gain considerations.
The proposed dwelling, by virtue of its width, positioning and siting fails to relate to the contextual character where the site is located and the dwellings at Garrard Road and Lynch Hill Lane. The development is at odds with and fails to respect the established character of the wider context and would appear as an incongruous addition to the character of the area, resulting in signifcant and demonstrable harm. The proposed dwelling would result in a cramped form of development with poor outlook for internal rooms. The proposal is therefore contrary to Core Policy 8 of the Core Strategy (2008), saved policies H13, and EN1 of the Slough Local Plan (2004) and contrary to paragraph 130 of the National Planning Policy Framework (2024).
The loss of amenity space for the host dwelling is symptomatic of overdevelopment of this backland site. For the proposed dwelling, the only amenity space proposed would not be sufficient secure to ensure it is private and would be directly overlooking by nos. 60 and 60a Garrard Road. The proposal is therefore contrary to Core Policy 8 of the Core Strategy (2008), saved policies H13, H14 and EN1 of the Slough Local Plan (2004) and contrary to paragraph 130 of the National Planning Policy Framework (2024).
The development is herby refused based on the submitted drawings: a) Drawing No. 9456 PL-01 Rev 01, Dated 10/12/2025, Received 10/12/2025 b) Drawing No. 9456 PL-02 Rev 01, Dated 10/12/2025, Received 10/12/2025 c) Drawing No. 9456 PL-04.01, Dated 10/12/2025, Received 10/12/2025 d) Drawing No. 9456 PL-04.02 Dated 10/12/2025, Received 10/12/2025 e) Drawing No. 9456 PL-04.03, Dated 10/12/2025, Received 10/12/2025 f) Drawing No. 9456 PL-04.04, Dated 10/12/2025, Received 10/12/2025 g) Drawing No. 9456 PL-04.05, Dated 10/12/2025, Received 10/12/2025 h) Drawing No. 9456 PL-04.06, Dated 10/12/2025, Received 10/12/2025
In dealing with this application, the Local Planning Authority has been mindful of its duty to work with the applicant in a positive and proactive manner. However, in this case, it has not been possible for the LPA to suggest solutions to the key issues and reasons for refusal as any amendments to the design would still have been unlikely to be acceptable in design terms. It is the view of the Local Planning Authority that the proposed development does not improve the economic, social and environmental conditions of the area for the reasons given in this notice and it is not in accordance with the National Planning Policy Framework.
Insufficient information has been provided to satisfy the Local Planning Authority that the development is exempt from Biodiversity Net Gains or can provide a 10% Biodiversity Net Gain, either within the site or through the use of contributions towards habitat creation off-site. The proposal would therefore fail to comply with Schedule 7A of the Town and Country Planning Act 1990 (as inserted by Schedule 14 of the Environment Act 2021, Core Policy 9 of the Core Strategy, and the National Panning Policy Framework.
The proposed car parking spaces and access point is narrow and may be at a point where visibility is substandard and not in accordance with the Manual for Streets. There is also insufficient turning space within the site to allow for vehicles to exit the site in forward gear. There is also insufficient space to provide for a separate 1m pedestrian access. This could cause a highways safety problem and conflict between vehicles, pedestrians and other highway users relating to the access to the property, including for refuse collection and for emergency vehicles. Therefore, the development is contrary to Slough Core Strategy (2006 – 2026) Core Policy 7 and the National Planning Policy Framework 2024.
The drawings are inconsistent as the Block Plan and Site Plan submitted do not correspond with each other and demonstrate two dwellings of different siting/ layout. Planning permission cannot be granted for this proposal as the plans are inaccurate and therefore it is not possible to verify whether the development would comply with the policies in the development plan. Notwithstanding this, the overall design and appearance of the dwelling in both layout scenarios is considered to be of a poor design quality that is harmful to the appearance of the character of the area.
