Planning conditions
  1. This application requires biodiversity net gain consideration
  2. This application is claiming an exemption from biodiversity net gain.
  3. The application site comprises an unlawful outbuilding which is being occupied as a self-contained dwellinghouse. Furthermore, the land to the rear of the main dwelling, No.44 Mead Avenue, has been sub-divided by erecting fencing, thus creating a separate entrance to the unlawful outbuilding which has resulted in substandard amenity space being retained to serve the original dwellinghouse. Officers sought to work with the applicant and their agent and requested that this unlawful development be regularised, however the applicant has refused to do so. As such, the drawings do not accurately reflect the site's layout, lawful use, nor has it been demonstrated that the proposals would not raise significant child safeguarding concerns. There is no certainty over what is actually being proposed in this instance, given the unlawful development that occupies the site, and the LPA cannot therefore be satisfied that the proposals would comply with the Development Plan including Saved Policies EN1 and H14 of the Slough Local Plan (2004) and Core Policies 8 and 11 of the Core Strategy (2008).
  4. In the absence of a legal agreement to secure placements for children in or from Slough in the first instance, the proposals are contrary to Core Policy 11 of the Core Strategy (2008).
  5. It is the view of the Local Planning Authority that the proposed development does not improve the economic, social and environmental conditions of the area for the reasons given in this notice and it is not in accordance with the National Planning Policy Framework.
  6. Drawings considered: - 01-ELF-BLP (Location Plan), dated December 2025, received on 24/12/2025 - 01-ELF-BLP (Block Plan), dated December 2025, received on 08/01/2026 - A3.01, dated 7 January 2026, received on 08/01/2026 - A3.01P, dated 7 January 2026, received on 08/01/2026 - A3.01RR, dated 7 January 2026, received on 08/01/2026 - A3.01PRP, dated 7 January 2026, received on 08/01/2026 - A3.01RE, dated 7 January 2026, received on 08/01/2026 - A3.01REP, dated 7 January 2026, received on 08/01/2026 - A3.01SE, dated 7 January 2026, received on 08/01/2026 - A3.01SEP, dated 7 January 2026, received on 08/01/2026 - A3.01E, dated 7 January 2026, received on 08/01/2026 - A3.01EP, dated 7 January 2026, received on 08/01/2026 - A3.01E2, dated 7 January 2026, received on 08/01/2026 - A3.01E2P, dated 7 January 2026, received on 08/01/2026
  7. Planning permission cannot be granted for this proposal as the plans are inconsistent and therefore it is not possible to verify whether the development would comply with the policies in the development plan.
