The proposed amendments to the development approved within planning permission P/15790/002 dated 04/07/2022 would fundamentally alter the approved description of development. The proposed variations to condition 2 of planning permission P/15790/002 dated 04/07/2022 would not fall within the scope of Section 73 of the Town and Country Planning Act 1990 (as amended) and full planning permission would be required.
In the event that the proposed variation of planning permission P/15790/002 dated 04/07/2022 could be considered, the Local Planning Authority would refuse permission to vary condition 2, as some bedroom sizes fall below the Nationally Described Space Standards, and would provide poor and cramped living conditions for future occupiers which is a symptom of poor design; the size of the rear gardens would be severely inadequate for the size of the resultant dwellings, resulting in poor quality private amenity space for future occupiers. The development would fail to provide the minimum vehicle parking on site required for the size of the resultant dwellings, with a detrimental impact to the parking environment within the surrounding public highway. The proposal is contrary to Core Policies 7 and 8 of The Slough Local Development Framework, Core Strategy 2006-2026, Development Plan Document, December 2008 and policies EN1, H14 and T2 of The Adopted Local Plan for Slough 2004, and the National Planning Policy Framework
The development hereby refused was submitted with the following plans and drawings: (a) Drawing No.JASPAL/PLAN/001, Dated 12th February 2026; Received 18/02/2026 (b) Drawing No.JASPAL/PLAN/002, Dated 12th February 2026; Received 18/02/2026 (c) Drawing No.JASPAL/PLAN/003, Dated 12th February 2026; Received 18/02/2026
It is the view of the Local Planning Authority that the development does not improve the economic, social and environmental conditions of the area for the reasons given in this notice and it is not in accordance with the National Planning Policy Framework. The Local Planning Authority consider that the application could not be made acceptable through requesting amendments, without substantially changing the nature of the proposal. In accordance with paragraph 39 of the NPPF 2024, the Council takes a positive and creative approach to development proposals, focused on solutions. To assist applicants in submitting development proposals, the Local Planning Authority (LPA) has produced planning policies and written guidance to guide applicants when submitting applications. These are all available on the Council's website. A pre-application advice service is also offered. The applicant did not seek to engage with the LPA prior to the submission of this application through the established formal pre-application advice service. In accordance with paragraph 41 of the NPPF 2024, the applicant is encouraged to utilise this service prior to the submission of any future formal planning applications, in order to engage pro-actively with the LPA to discuss possible solutions to the reasons for refusal.
Notwithstanding the proposed amendments to approved plans planning permission P/15790/002 dated 04/07/2022 to create additional bedrooms, the submitted existing floor plans represent a departure from those approved, as such it appears that the development has not been implemented in accordance with planning permission.
