  1. The applicant has failed to demonstrate, on the balance of probabilities, that the single storey rear extension currently present on the site was substantially completed more than four years prior to the date of the application and has therefore become lawful through the passage of time. Whilst the application is supported by two sworn affidavits and three photographs purportedly dating from 2017, the Local Planning Authority is not satisfied that the evidence submitted is sufficiently precise, unambiguous or cogent to establish the lawfulness of the development sought to be certified. The Local Planning Authority is not satisfied that the evidence demonstrates, on the balance of probabilities, that the existing development is lawful within the meaning of Section 191 of the Town and Country Planning Act 1990 (as amended). A Certificate of Lawful Existing Development is therefore refused.
