Condition 9 - Bird Hazard Management Plan - Details not approved The proposed Bird Hazard Management Plan from RED Ecology, ref 1144.BHMP.Final.01, dated 01/2026, received 23/06/2026 is unacceptbale in a number of parts of the report as detailed below: 1. The report fails to clarify that the plan aligns with Civil Aviation Authority (CAA) guidance note CAP 772 – Wildlife hazard management at aerodromes. 2. Section 3.4 is unverified as no information is provided as to the current layout and structure of the existing development and it is not possible to confirm that the approved buildings will not result in an increase in bird strike risk. 3. Appendix 1 does not include reference to the composition of berry-bearing vs. non-berry-bearing planting which is stated in Section 3.5 and 4.72 of the report as being apparent. 4. Insufficient detail is provided in the report with respect to how flat roofs will be made (safely) accessible by personnel to complete monitoring checks and, if necessary, undertake licenced control/management of breeding birds. 5. The proposed scheme includes bird scarers and visual deterrents to ward off birds but these are of limited value for the purposes of bird dispersal because birds typically habituate to them. Other methods of dispersal are required to be considered and accounted for. 6. The report states that nests will be “cleared away without the need for further advice or intervention”. This is unacceptable as the nests of most wild birds, including nests under construction, are legally protected. It should be clarified within the plan that dispersal or removal of nests and/or eggs would only be undertaken following successful application to use the necessary class licence (Natural England CL12); evidence of which would be provided to the LPA. 7. The report (Section 5) fails to account for the fact that not all roosting birds can be dispersed. In particular, the dependent young of species listed on Schedule 1 of the Wildlife and Countryside Act 1981, as amended, are legally protected from intentional or reckless disturbance. (Schedule 1 bird species that could potentially be in the vicinity include hobby Falco subbuteo, red kite Milvus milvus and black redstart Phoenicurus ochruros). As a result the Council is unable to accept the plan in its current guise and the details submitted are unacceptable in light of Core Policy 9 of the Core Strategy 2006-2026 and the policies N2 and N6 of the NPPF.
