Planning conditions
  1. The site is located within a Flood Zone 2 and no sequential test has been provided to enable officers to conclude that there are no other potential development sites in the local area that do not fall within the flood zone. In addition, no information regarding safe escape has been provided. The application therefore fails the requirements of the NPPF and the government’s National Planning Practice Guidance as it cannot be duly concluded that the development would not unnecessarily put occupiers of the proposed development at risk of the consequences of flooding.
  2. The proposed dwelling, by virtue the internal size, lack of any outside amenity provision, insufficient information to demonstrate suitable level of daylight / sunlight, and positioning above existing noise generating uses without any noise assessment, would provide poor quality residential accommodation, failing to comply with Policy H14 of the Local Plan and the NPPF.
  3. The proposal by virtue of its additional storey, general massing and proximity, would have an overbearing impact on the neighboring rear garden of 17 Grasmere Avenue, to the extent that it would compromise the ability of its occupiers to enjoy their private amenity space. It would therefore fail to comply with Policy EN1 and EN2 of the Local Plan and Core policy 8 of the Core Strategy in respect of amenity impacts.
  4. The proposed extension, by virtue of its scale, massing, and general design would have a detrimental impact on the character and appearance of the application property, particularly given that it’s flat roofed utilitarian design would erode any original character. It would also therefore have a detrimental impact on the character and appearance of the local street-scene, contrary to the aims of Policies EN1 and EN2 of the Local Plan and Core policy 8 of the Core Strategy.
  5.   6. It is the view of the Local Planning Authority that the proposed development does not improve the economic, social and environmental conditions of the area for the reasons given in this notice and it is not in accordance with the National Planning Policy Framework.
