Planning conditions
  1. The submitted drawings appear to be inaccurate and do not accurately reflect the existing situation on site. In particular, discrepancies have been identified regarding the fenestration in the outbuilding, and the drawings fail to show an existing WC. As a result, the Local Planning Authority cannot rely on the submitted plans as an accurate representation of the development. A reason for refusal has therefore been included on the grounds that the application has been supported by misleading and inaccurate information, preventing officers from undertaking a full and proper assessment of the proposal.
  2. It has not been demonstrated to the satisfaction of the Local Planning Authority that the outbuilding would remain incidental or ancillary to the dwellinghouse and used solely for purposes associated with the residential enjoyment of the occupants of the main dwellinghouse. In addition, the submitted plans are inaccurate and do not accurately reflect the existing site circumstances. In particular, the floor plans identify part of the outbuilding as a living area whilst failing to show the existing WC. Consequently, the Local Planning Authority is unable to establish the existing or proposed use of the outbuilding with any degree of certainty, nor undertake a full and proper assessment of the proposal. The application has therefore failed to demonstrate compliance with paragraph 9.11 of the RESPD 2010, Local Plan Policy H18, Core Policy 4, and 8 of the Core Strategy and the NPPF.
