Planning conditions
  1. This application requires biodiversity net gain consideration
  2. This application is claiming an exemption from biodiversity net gain.
  3. The proposed development to create a new dwelling, by virtue of the extension's width, depth, height, positioning, massing, bulk, roof form and design, would fail to respect the design, character and proportions of the existing semi-detached dwellings and would appear as an incongruous addition in the streetscene. The particularly narrow width of the new dwelling, together with the impact on No.70 Belfast Avenue, insufficient amenity space and insufficient parking provision, are all indicators of a poor quality and visually cramped proposal that would result in an overdevelopment of the plot. The proposals would be readily seen from the adjacent footpath and would adversely affect the local character of the area. The proposals are therefore contrary to DP1, DP2, DP3, EX11, EX12, EX13, EX26, EX31 and EX48 of the Residential Extensions Guidelines SPD (2010), Saved Policies EN1, EN2, H13, H14, H15 and T2 of the Slough Local Plan (2004), Core Policy 8 of the Core Strategy (2008) and contrary to Paragraphs 115-117, 131 and 135 of the National Planning Policy Framework (2024).
  4. It is the view of the Local Planning Authority that the proposed development does not improve the economic, social and environmental conditions of the area for the reasons given in this notice and it is not in accordance with the National Planning Policy Framework.
  5.   6. The application site comprises unlawful extensions at the rear which do not appear to benefit from formal planning permission, nor would they amount to ‘permitted development’ as set out in the Town and Country (General Permitted Development) Order 2015 (as amended). Officers sought to work with the applicant and their agent and requested that this unlawful development be regularised, however the applicant has refused to do so. As such, the drawings do not accurately reflect the site's lawful use or layout and the LPA cannot therefore be satisfied that the proposals would comply with the Development Plan including Saved Policies EN1, EN2, H14 and H15 of the Slough Local Plan (2004) and Core Policy 8 of the Core Strategy (2008).
