The proposed use would not alter the activity or character at the site beyond a typical residential C3 use and would therefore not comprise of a material change of use falling under the definition of development by virtue of section 55 of the 1990 Town and Country Planning Act (as amended), Therefore, the proposal is considered to be lawful under the provisions of Section 192 of the Town and Country Planning Act 1990 (as amended) as a Class C2 facility as the proposed use.
