Decision & conditions

Refusal
799134Decision_Refusal_of_Planning_Permission_959(1).pdf
Planning conditions
  1. By reason of its increased height, scale and footprint, and its construction in brick rather than the oak/timber-framed design previously negotiated and approved under application R21/0367, the building now substantially constructed represents a visually prominent and incongruous form of development which fails to respect or complement the high-quality, individually designed character of the surrounding development. In addition, the building has been erected otherwise than in accordance with approved plans, in a form previously and specifically considered inappropriate in this location, and the intentional unauthorised nature of this development, in accordance with Policy DM8 of the National Planning Policy Framework, attracts substantial weight against the grant of retrospective planning permission. The proposal is therefore contrary to Policy SDC1 of the Rugby Borough Local Plan 2011-2031, Policy DP3 and Policy DM8 of the National Planning Policy Framework (August 2026). 2. By reason of its increased height and massing, and its siting just 5.5m from the front elevation and windows of Plot 13, the building would have an overbearing impact on, and result in unacceptable visual intrusion upon, the outlook enjoyed from the habitable room windows in the front elevation of that dwelling, to the detriment of the amenity of its occupiers. The proposal is therefore contrary to Policy SDC1 of the Rugby Borough Local Plan 2011-2031 and the guidance contained within the Council's Climate Change and Sustainable Design SPD and Policy DM8 of the National Planning Policy Framework (August 2026).
