- REASON FOR REFUSAL 3: Due to insufficient site specific information provided in regard to potential noise and odour control, the proposal would be harmful to the living conditions of nearby occupiers. Accordingly, the proposal is contrary to Policy SDC1 of the Rugby Borough Local Plan 2011-2031 (June 2019) and policies D1 and EN8 of the submission version of the Rugby Borough Local Plan (2025-2042) (April 2024) and paragraphs 135 (f) and 198 of the NPPF (2024).
- RELEVANT DEVELOPMENT PLAN POLICIES & GUIDANCE: Policy SDC1 - Sustainable Design Policy HS3 - Protection and Provision of Local shops, Community Facilities and Services of the Rugby Borough Local Plan 2011-2031 Policy D1 - Well Designed Places Policy EN8 - Environmental Protection and Amenity Policy W1 -Community Facilities of the submission version of the Rugby Borough Local Plan (2025-2042) National Planning Policy Framework 2024 The development plan policies referred to above are available for inspection on the Rugby Borough Council’s web-site www.rugby.gov.uk .
- REASON FOR REFUSAL 2: Due to the lack of detail for both the internal layout and the external alterations including storage of refuse and disposal of such, the proposal is unacceptable in its current form and as such it is considered contrary to policy SDC1 of the Rugby Borough Local Plan 2011-2031 (June 2019) and policies D1 and EN8 of the submission version of the Rugby Borough Local Plan (2025-2042) (April 2024) and paragraph 135 (a) and (f) of the NPPF (2024).
- REASON FOR REFUSAL 1: It has not been demonstrated that a Class E retail use is no longer economically viable, contrary to policy HS3 of the Rugby Borough Local Plan 2011-2031 (June 2019) and policy W1 of the submission version of the Rugby Borough Local Plan (2025-2042) (April 2024)
