Planning conditions
  1. CONDITION 1: The development to which this permission relates must not be begun later than the expiration of three years from the date of this permission. REASON 1: To comply with Section 91 of the Town & Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act, 2004.
  2.   3. CONDITION 4: A Habitat Management and Monitoring Plan (HMMP) for a minimum 30-year timeframe shall be submitted to, and be approved in writing by, the local planning authority prior to the commencement of the development. The content of the HMMP shall include the following: a) Description and evaluation of features to be managed. b) Ecological trends and constraints on site that might influence management. c) Aims and objectives of management. d) Appropriate management options for achieving aims and objectives. e) Prescriptions for management actions. f) Preparation of a work schedule (including annual work plan capable of rolling forward over a five-year period). g) Details of the body or organisation responsible for implantation of the plan. h) Ongoing monitoring and remedial measures. i) The completed statutory metric applied to the application site to demonstrate that a biodiversity net gain will be achieved. j) Locations and numbers of bat and bird boxes, reptile, and amphibian refugia, invertebrate boxes k) Details of the legal and funding mechanism(s) by which long-term implementation of the plan will be secured by the developer with the management body(ies) responsible for its delivery. The plan shall also set out (where results from monitoring show that conservation aims and objectives of the HMMP are not being met) how contingencies and/or remedial action will be identified, agreed, and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme. The approved plan will be implemented in accordance with the approved details. REASON 4: To ensure a mandatory Biodiversity Net Gain in accordance with the Environment Act, the NPPF and to safeguard biodiversity in accordance with the Local Plan Policy NE1.
  4. CONDITION 5: The development hereby permitted (including ground clearance works) shall not commence until a protected species method statement for badgers, hedgehogs and GCN (to include timing of works, toolbox talk, ecologist supervision of vegetation clearance, procedure if protected species are found and reasonable avoidance measures) has been submitted to and approved in writing by the Local Planning Authority. Such approved measures shall thereafter be implemented in full. REASON 5: To ensure that protected, important and priority species and their habitats are not harmed by the development.
  5. CONDITION 6: The external lighting hereby permitted shall only be activated for emergency use only. Lighting levels must not exceed 3000 Kelvin and shall be directed inwards to focus on the development (antennas and cabinets) only. REASON 6: In the interest of protecting landscape character and also nature conservation in accordance with policies NE1 and NE3 of the Rugby Borough Local Plan.
  6. CONDITION 7: The proposed boundary fencing hereby approved shall be carried out in accordance with Drawing No.04025-HBA-DR-0013 Rev.E (Proposed Detailed Site Plan) received by the local planning authority on 22.05.2026. The fencing shall match that used on the remainder of the existing site in terms of material, colour and design. REASON 7: In the interest of protecting landscape character and the appearance of the site.
  7. CONDITION 8: No development shall take place until a Written Scheme of Investigation (WSI) for a programme of archaeological work has been submitted to and approved in writing by the Local Planning Authority. The development, and any archaeological fieldwork, post-excavation analysis, publication of results and archive deposition detailed in the approved Written Scheme of Investigation, shall be undertaken in accordance with that document. REASON 8: To comply with Policy SDC3 of the Rugby Local Plan (June 2019) and the relevant aims and objectives of the National Planning Policy Framework (NPPF).
  8. INFORMATIVE: Visibility from an access onto a 60 miles/hr road should be 2.4m x 215m in both directions. At present this cannot be achieved from the existing access due to adjacent hedges and trees within the visibility splays. Whilst the Highway Authority considers that the proposed development does not represent an intensification in use of the access, in the interest of highway safety the Highway Authority recommends that vegetation either side of the access within land under the ownership/management of the applicant and/or the Highway Authority is cut back and maintained in order to maximise visibility splays. Pursuant to Section 149 and 151 of the Highways Act 1980, the applicant/developer must take all necessary action to ensure that mud or other extraneous material is not carried out of the site and deposited on the public highway. Should such deposits occur, it is the applicant's/developer's responsibility to ensure that all reasonable steps (e.g. street sweeping) are taken to maintain the roads in the vicinity of the site to a satisfactory level of cleanliness
  9. CONDITION 3: The facing materials to be used on the development hereby approved shall be as specified on the application form, received by the Council on (13/02/2026) and on the plans as listed in condition 2. REASON 3: To ensure a satisfactory external appearance and for the avoidance of doubt.
  10. INFORMATIVE: In view of the nearby ponds,care should be taken when clearing the ground prior to development and when storing materials on site. If evidence of specially protected species such as reptiles or amphibians is found (great crested newt,grass snake,common lizard or slow-worm),work should stop while WCC Ecological Services (01926 418060) or Natural England (02080 261089) are contacted. Reptiles and amphibians are protected to varying degrees under the 1981 Wildlife and Countryside Act and the Countryside and Rights of Way Act 2000 and great crested newts are additionally deemed Protected Species under the Conservation of Habitats and Species Regulations 2017.
  11. INFORMATIVE: This planning permission is subject to pre-commencement conditions which require details/drawings to be submitted to and approved in writing by the Local Planning Authority before ANY development may lawfully commence. Any development commenced in breach of these pre-commencement conditions will be unauthorised,a breach of planning control,and liable to immediate Enforcement and Stop Notice action.
  12. DEEMED CONDITION: In accordance with the Environmental Act 2021, Schedule 14, paragraph 13 and the Town and Country Planning Act 1990 Schedule 7A, paragraph 13: the development may not be begun unless— (a) a biodiversity gain plan has been submitted to the planning authority, and (b) the planning authority has approved the plan. The planning authority, for the purposes of determining whether to approve a Biodiversity Gain Plan in respect of this permission would be Rugby Borough Council.
