- In pursuance of their powers under the above-mentioned Act and Order, the Rugby Borough Council (“the Council”) as local planning authority HEREBY REFUSE your application for a certificate of lawful use or development under section 192 of the Act, dated as per the application date above, in respect of the development described above. REASON FOR REFUSAL: The proposed outbuilding does not comply with the permitted development requirements of Class E of Part 1, Schedule 2 of the (General Permitted Development) Order 2015 (as amended), as the proposal fails to demonstrate that the outbuilding would have an incidental use.
