CONDITION 1: The development to which this permission relates must not be begun later than the expiration of three years from the date of this permission. REASON: To comply with Section 91 of the Town & Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act, 2004.
CONDITION 2: The development shall be carried out in accordance with the plans and documents detailed below: Drawing titled ‘Site Plan’ received on 18.12.2025 Drawing titled ‘Location Plan and Block Plan’ received on 18.12.2025 Drawing titled ‘Existing Floor Plans’ received on 18.12.2025 Drawing titled ‘Existing Elevations’ received on 18.12.2025 Drawing titled ‘Proposed Floor Plans’ received on 24.02.2026 Drawing titled ‘Proposed Elevations’ received on 24.02.2026 Planning Statement received on 18.12.2025 Noise Insulation Report (BS8233) Revision 2 prepared by ‘Environmentally Sound Limited’ (Dated 15 December 2025) REASON: For the avoidance of doubt and to ensure that the details of the development are acceptable to the Local Planning Authority.
CONDITION 3: The facing materials to be used on the external walls and roof shall as specified on the drawing titled ‘Proposed Elevations’ received by the Council on 24.02.2026 received by the Council on 05/10/2022. REASON: To ensure a satisfactory external appearance and for the avoidance of doubt in accordance with Policy SDC1 of the Rugby Local Plan.
CONDITION 4: The outbuilding to the eastern end of the site and labelled as 'FORGE' on the approved drawings, shall be used for Community use Class F2(b) and for no other purposes including any other purpose in Class F.2 of the Schedule to the Town & Country Planning (Use Classes) Order 1987 (as amended) or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that order with or without modification. REASON: In the interests of the amenities of the locality in accordance with Policy SDC1 of the Rugby Local Plan.
CONDITION 5: In order to reduce the likelihood of local residents being subjected to adverse levels of noise from the use of the outbuilding to the eastern end of the site labelled as 'FORGE’, the opening hours for this facility are limited to the following times: - Monday – Friday 9 a.m. – 8.00 p.m. Saturday and Sunday 10 a.m. – 6.00 p.m. Closed on Bank Holidays. REASON: In interest of residential amenity in accordance with Policy SDC1 of the Rugby Local Plan.
CONDITION 6: Prior to the first occupation of the residential development hereby permitted, works shall be completed in accordance with the approved ‘Noise Insulation Report (BS8233) Revision 2’ prepared by ‘Environmentally Sound Limited’ (Dated 15 December 2025). REASON: In interest of residential amenity in accordance with Policy SDC1 of the Rugby Local Plan.
CONDITION 7: The development shall not be occupied until the existing vehicular access has been closed and the kerb and footway have been reinstated in accordance with the standard specification of the Highway Authority. REASON: In the interest of highway safety.
CONDITION 8: Prior to the first occupation of the residential development hereby permitted, a comprehensive landscaping scheme shall be submitted to and approved in writing by the Local Planning Authority. The approved landscaping scheme shall be implemented no later than the first planting season following first occupation of the development. If within a period of 10 years from the date of planting, any vegetation is removed, uprooted, destroyed or dies, (or becomes in the opinion of the Local Planning Authority seriously damaged or defective), replacement of the vegetation of the same species and size originally planted shall be planted at the same place. REASON: To ensure the proper development of the site and in the interest of visual amenity in accordance with Policy SDC1 of the Rugby Local Plan.
CONDITION 9: Prior to the first occupation of the development hereby permitted, full details of cycle parking and bins shall be submitted to and approved in writing by the Local Planning Authority. Details shall include: - Design and materials of cycle parking facility and bins (including recycling and general waste) - Waste Management Plan for both residential and commercial elements of the approved scheme The development shall not be carried out other than in accordance with the approved details and shall thereafter be permanently retained throughout the lifetime of the development. REASON: In the interest of visual and residential amenity and for the cycle storage to comply with the Parking standards set out in the Planning Obligations SPD and Appendix 2 section 5 of the Local Plan and to ensure adequate waste storage is provided.
INFORMATIVE 1: Condition number 7 requires works to be carried out within the limits of the public highway. Before commencing such works the applicant / developer must serve at least 28 days notice under the provisions of Section 184 of the Highways Act 1980 on the Highway Authority‘s Area Team. This process will inform the applicant of the procedures and requirements necessary to carry out works within the Highway and, when agreed, give consent for such works to be carried out under the provisions of S184. In addition, it should be noted that the costs incurred by the County Council in the undertaking of its duties in relation to the construction of the works will be recoverable from the applicant/developer. In accordance with Traffic Management Act 2004 it is necessary for all works in the Highway to be noticed and carried out in accordance with the requirements of the New Roads and Streetworks Act 1991 and all relevant Codes of Practice. Before commencing any Highway works the applicant / developer must familiarise themselves with the notice requirements, failure to do so could lead to prosecution. Application should be made to the Street Works Manager, Budbrooke Depot, Old Budbrooke Road, Warwick, CV35 7DP. For works lasting ten days or less, ten days notice will be required. For works lasting longer than 10 days, three months notice will be required.
INFORMATIVE 2: The applicant is directed to the RBC Guidance for charging for the provision of wheeled bins and the design of bin storage facilities which advises on the levels of waste and recycling facilites required to meet the needs of communal living arrangements. INFORMATIVE 3: The applicant is encouraged to incorporate measures to assist in reducing their impact upon the Air Quality Management Area as part of this development. Initiatives could include the installation of an ultra-low emission boiler (<40mg/kWh), increased tree planting/landscaping, solar thermal panels, and the incorporation of electric vehicle charging points on any car parking.
