- Rugby Borough Council hereby certify that on the application date above the use described in the First Schedule hereto in respect of the land specified in the Second Schedule hereto and edged red on the plan attached to this certificate would be lawful within the meaning of section 191 of the Town and County Planning Act 1990 (as amended) for the following reasons: The Council are of the opinion that sufficient information has been submitted to demonstrate that, on the balance of probabilities, the site has been continuously used as an 8-bed HMO for at least 10 years prior to the date of the application.
