Rugby Borough Council hereby certify that on the application date above the operations described in the First Schedule hereto in respect of the land specified in the Second Schedule hereto and edged red on the plan attached to this certificate would be lawful within the meaning of section 192 of the Town and County Planning Act 1990 (as amended) for the following reasons: The proposed garage conversion meets the permitted development requirements of Schedule 2, Part 1, Class A of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). FIRST SCHEDULE: Proposed garage conversion as detailed in the following documents: Application form Existing plans, block plan and site location plan, drawing no. 4431-01 Proposed plans, drawing no. 4431-02 Received by Council, 15/09/2025 SECOND SCHEDULE: Ash Grove, Frankton Lane, Stretton-On-Dunsmore, Rugby, CV23 9JQ as edged in red on the plan attached to this certificate.
  2. NOTES: *delete as applicable 1. This certificate is issued solely for the purpose of sections 191/192* of the Town and Country Planning Act 1990 (as amended). 2. It certifies that the use/operations/matter* specified in the First Schedule taking place on the land described in the Second Schedule was/were/would* have been/would be lawful*, on the specified date and, thus, was not/were not/would not have been* liable to enforcement action under Part 7 of the 1990 Act on that date. 3. This certificate applies only to the extent of the use/operations/matter* described in the First Schedule and to the land specified in the Second Schedule and identified on the attached plan (IF RELEVANT). Any use/operations/matter* which is/are* materially different from that/those* described or which relate to other land may render the owner or occupier liable to enforcement action. 4. The effect of the certificate is also qualified by the proviso in section 192(4) of the 1990 Act, as amended, which states that the lawfulness of a described use or operation is only conclusively presumed where there has been no material change, before the use is instituted or the operations begun, in any of the matters relevant to determining such lawfulness. (DELETE IF NOT APPLICABLE) 5. If the applicant is aggrieved by the alteration to the description/site* plan given in the First Schedule that accompanies this decision they may appeal to the Secretary of State under Section 195 of the Town and Country Planning Act 1990 (as amended). You must use a Certificate of Lawful Use or Development Appeal Form when making your appeal. If requesting forms from the Planning Inspectorate, please state the appeal form you require. Please note, only the applicant possesses the right of appeal. (DELETE IF NOT APPLICABLE)
