Planning conditions
  1. CONDITION 1: The development to which this permission relates must not be begun later than the expiration of three years from the date of this permission. REASON: To comply with Section 91 of the Town & Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act, 2004.
  2. CONDITION 2: The development shall be carried out in accordance with the plans and documents detailed below: The Application Form Proposed Site Plan with TRPZ - 1770A-0502-01 Ridgeway Ecology - Phase 1&2 Bat Survey 18th July 2025 (Amended 26th August 2025) Arbortrack Systems Ltd - Arboricultural Impact Assessment & Method Statement: Ref: jwmb/rpt3/fieldview/AIAAMS - Date: 22nd August 2025 Site Location and Block Plan - 1770A-0200-01 Proposed Site Plan - 1770A-0500-01 Received by the Local Planning Authority on the 27th August 2025 Proposed Plans and Elevations - 1770A-0501-02 Received by the Local Planning Authority on the 3rd December 2025 REASON: For the avoidance of doubt and to ensure that the details of the development are acceptable to the Local Planning Authority.
  3. CONDITION 3: No above ground development shall commence unless and until full details of the colour, finish and texture of all new materials to be used on all external surfaces, together with samples of the facing bricks, roof tiles and timber and the specification of the windows have been submitted to and approved in writing by the Local Planning Authority. The development shall not be carried out other than in accordance with the approved details. REASON: To ensure a satisfactory external appearance and in the interests of the visual amenities of the locality.
  4. CONDITION 4: The dwelling hereby permitted shall be constructed only as a self-build house within the meaning of Section 1 (A1) of the Self-build and Custom Housebuilding Act 2015: (A1) In this Act "self-build and custom housebuilding" means the building or completion by- (a) individuals, (b) associations of individuals, or (c) persons working with or for individuals or associations of individuals, of houses to be occupied as homes by those individuals. (A2) But it does not include the building of a house on a plot acquired from a person who builds the house wholly or mainly to plans or specifications decided or offered by that person. REASON: Exemption from biodiversity net gain has been obtained because the dwelling is a self-build/custom build property.
  5. CONDITION 5: All tree protection measures and tree works identified within the Arboricultural Method Statement dated 22nd August 2025 (Ref: jwmb/rpt3/fieldview/AIAAM), relating to the approved design details (including the erection of protective fencing to create construction exclusion zones) must be implemented prior to the construction phase and to the satisfaction and written approval of the Local Planning Authority. All tree works must be carried out in accordance with BS3998:2010 (Tree work - Recommendations). Protective measures must remain in place until the completion of all construction works. Construction exclusion zones should be treated as sacrosanct with no building activity, ground disturbance or storage of building materials taking place within them. During the construction phase, no retained tree shall be cut down, uprooted or destroyed, nor shall any retained tree be pruned in any manner, be it branches, stems or roots, other than in accordance with the approved plans and particulars, without the prior written approval of the Local Planning Authority. REASON: To ensure retained trees are successfully incorporated into the design and are suitably protected from damage during the construction phase.
  6. CONDITION 8: Prior to the first occupation of each dwelling broadband infrastructure shall be provided to that dwelling to allow broadband services to be provided. REASON: To provide broadband connectivity for future occupiers.
  7. CONDITION 7: Prior to the first occupation of the dwelling , the existing outbuilding, as annotated on the proposed site plan shall be demolished. REASON: To ensure that the proposed development is acceptable.
  8. CONDITION 6: Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended), or any order revoking or re-enacting those orders, no development shall be carried out which comes within Classes A, B and D of Schedule 2 Part 1 of the Order without the prior written permission of the Local Planning Authority. REASON: In the interest design and the countryside location.
  9. CONDITION 9: The dwellings hereby approved shall incorporate measures to limit water use to no more than 110 litres per person per day within the home in accordance with the optional standard 36 (2b) of Approved Document G of the Building Regulations 2010 (as amended). REASON: In the interests of sustainability and water efficiency.
  10. CONDITION 10: Biodiversity Management Plan (BMP) The development hereby permitted (including site clearance) shall not commence until a Biodiversity Management Plan (BMP) to include a plan of habitats and protected and priority species mitigation, biodiversity enhancements, long-term management and monitoring (to include location of measures, installation timescale, timing of works, replacement planting details if applicable, and species lists for proposed planting) has been submitted to and approved in writing by the Local Planning Authority. Such measures will be shown on all applicable annotated site plans and elevations, such approved mitigation and enhancement measures shall thereafter be implemented in full and maintained in strict accordance with the approved details in perpetuity. REASON: To enhance the nature conservation value of the site and ensure biodiversity net gain in accordance with the NERC act, NPPF, ODPM Circular 2005/06.
  11. CONDITION 11: Schedule of bat mitigation measures The development hereby permitted shall not commence until a detailed schedule of bat mitigation measures (to include timing of works, ecologist supervision of destructive works, toolbox talk, procedure if bats are found, including provision of a bat box during works, replacement roost details, including location and timetable for installation, monitoring and further survey if necessary) has been submitted to and approved by the Local Planning Authority. Such approved mitigation measures shall thereafter be implemented in full and maintained in perpetuity. REASON: To ensure protected, important and priority species and their habitats are not harmed by the development.
  12. INFORMATIVE 1: Work should avoid disturbance to nesting birds. Birds can nest in many places including buildings, trees, shrubs, dense ivy, and bramble/rose scrub. Nesting birds are protected under the Wildlife and Countryside Act 1981 (as amended). The main nesting season lasts approximately from March to September inclusive, so work should ideally take place outside these dates if at all possible. N.B birds can nest at any time, and the site should ideally be checked by a suitably qualified ecologist for their presence immediately before work starts, especially if during the breeding season.
