Planning conditions
  1. The development does not provide the required distance of 5metres from the edge of the carriageway/highway to the access gates. As a result, the development does not allow for vehicles to completely manoeuvre off the public highway and footway before stopping to open the access gate, promoting highway safety concerns. The proposal is therefore contrary to Section 9 of the NPPF which states that developments should achieve safe and suitable access to the site for all users and contrary to Policy D1 of the Rugby Borough Local Plan.
  2. RELEVANT DEVELOPMENT PLAN POLICIES & GUIDANCE: Rugby Borough Council Local Plan 2011-2031, June 2019 Local Plan Policy: D1 Transport National Planning Policy Framework (NPPF) 2024 The development plan policies referred to above are available for inspection on the Rugby Borough Council’s web-site www.rugby.gov.uk .
  3. STATEMENT OF POSITIVE ENGAGEMENT: In dealing with this application Rugby Borough Council has actively sought to work with the applicant in a positive and proactive manner, in accordance with paragraph 39 of the NPPF.
