The Authority notes the proposed installation of fixed line broadband apparatus at Lawrence Road, Wittering, Peterborough PE8 6EH in the location shown on the location plan and detailed within the notification submitted by Openreach. The Authority is satisfied that the proposed works fall within the permitted development rights available to statutory undertakers under Part 16 of Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) and may therefore by undertaken without the express benefit of planning permission. The Authority advises that there are no Article 4 Directions affecting the site that would remove the relevant permitted development rights for the proposed works. For the avoidance of doubt, this response is provided in relation to the Regulation 5 notification and should not be taken as a formal determination of lawfulness. Should you require a formal determination, you will need to submit an application for a Certificate of Lawfulness under Section 192 of the Town and Country Planning Act 1990. Application forms are available from our website at www.peterborough.gov.uk or upon request. I trust the above advice is of assistance, however, should you require any further information, please do not hesitate to contact me on the details shown at the top of this letter.
