Condition 4 – Biodiversity Net Gain Plan - DISCHARGED Prior to the commencement of development, a biodiversity net gain plan must be submitted to and agreed in writing with by the Local Planning Authority. The biodiversity net gain plan shall address the following matters: (a) information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat (b) the pre-development biodiversity value of the onsite habitat (c) the post-development biodiversity value of the onsite habitat (d) any registered offsite biodiversity gain allocated to the development and the biodiversity value of that gain in relation to the development (e) any biodiversity credits purchased for the development, and (f) such other matters as the Secretary of State may by regulations specify. Thereafter, the development shall be carried out in accordance with the agreed approved details. Reason: In accordance with the requirements of Schedule 14, Part 1 of paragraph 14 of the Environment Act 2021 and Policy LP28 of the Peterborough Local Plan (2019). Plans and documents submitted in support of the discharge of C4: - Biodiversity Gain Plan - Statutory Biodiversity Metric Assessment: Having reviewed the submitted plan, the Officer agrees with the Wildlife Officer that the proposed details are acceptable and are in line with the BNG requirements. As such, the detail submitted is deemed acceptable for the Local Planning Authority to discharge the condition. Conclusion: The details submitted relating to condition 4 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition. Condition 4 is hereby discharged, subject to implementation in accordance with the approved details.
Condition 5 - Habitat Management and Monitoring Plan - NOT DISCHARGED Prior to commencement of development, a Habitat Management and Monitoring Plan (the HMMP) addressing the management of proposed and existing habitats in the proposed condition must be submitted to and approved in writing by the Local Planning Authority. The HMMP shall include the following: a) Purpose and conservation objectives for the proposed works. c) Detailed design(s) and/or working method(s) to achieve stated objectives. d) Extent and location/area of proposed works on appropriate scale maps and plans. e) Type and source of materials to be used where appropriate, e.g. native species of local provenance. f) Timetable for implementation. g) Persons responsible for implementing the works. h) Details of initial aftercare and long-term maintenance. i) Details for monitoring and remedial measures. The HMMP shall be implemented in accordance with the approved details and all features shall be retained in that manner thereafter for a period no less than 30 years or another approved period of time described within the HMMP. Monitoring reports shall be submitted to the relevant Local Planning Authority Officer in accordance with the agreed details within the HMMP. Reason: As significant enhancement has been triggered, council monitoring of the BNG proposals on this site is required. This will require a S106 to secure monitoring fees. A HMMP will be required to support this S106 to outline the required methods to achieve the enhancement and to be secured by the S106. Plans and documents submitted in support of the discharge of CX: - Habitat Management and Monitoring Plan Assessment: Having reviewed the submitted plan, the Officer agrees with the Wildlife Officer that the submitted HMMP submitted fails to respond to the questions raised at application stage. It is noted that a response has been provided within the covering letter however this information needs to be fully contained within the HMMP. With regards to these responses, the Wildlife Officer has also raised concerns regarding the approach and feels it is likely that under planting will be required at 15 years. Conclusion: The details submitted relating to condition 5 are deemed unacceptable to the Local Planning Authority. Condition 5 is hereby NOT DISCHARGED, and a revised HMMP will be required.
