Further to your notification received in respect of the above proposal (Applicant Reference: WH5FHK6J), the Local Planning Authority makes the following comments. The Local Planning Authority notes the proposed installation of: - 1 no. 10m light wooden telecommunications pole adjacent to No. 20 Church Close, Newborough, PE6 7RA; and - 1 no. 9m medium wooden telecommunications pole adjacent to No. 10 Walnut Close, Newborough, PE6 7RJ, as shown on the submitted location plan and detailed within the Regulation 5 notification submitted by Openreach on behalf of British Telecommunications plc. The Authority is satisfied that the proposed works fall within the permitted development rights available to Electronic Communications Code Operators under Part 16 of Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) and may therefore be undertaken without the express benefit of planning permission. The Council advises that there are no Article 4 Directions affecting the site that would remove the relevant permitted development rights for the proposed works. Notwithstanding the above, the Council requests that careful consideration is given to the final siting of the proposed apparatus. In particular, the pole proposed adjacent to No. 10 Walnut Close should be positioned so as not to adversely affect visibility for vehicles entering or leaving the adjacent driveway. In addition, the pole proposed adjacent to No. 20 Church Close should be sited to ensure that adequate footway width is retained and pedestrian movement is not impeded. For the avoidance of doubt, this response is provided in relation to the Regulation 5 notification and should not be taken as a formal determination of lawfulness. Should you require a formal determination, a Certificate of Lawfulness application under Section 192 of the Town and Country Planning Act 1990 would need to be submitted.
