Planning conditions
  1. Further to your notification received in respect of the above proposal (Applicant Reference: PBO149), the Local Planning Authority makes the following comments: The Local Planning Authority notes the proposed upgrade of base station at SW Fellow Gardens, Whittlesey Road, Peterborough, comprising: - The removal of the existing 15m Phase 9 monopole and 6no. antennas, to be replaced with a 20m Phase 8 monopole supporting 6no. antennas on the existing root foundation. - Other ancillary development thereto The Authority is satisfied that the proposed works fall within the permitted development rights available to Electronic Communications Code Operators under Part 16 of Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) and may therefore be undertaken without the express benefit of planning permission. The Council advises that there are no known Article 4 Directions affecting the site that would remove the relevant permitted development rights for the proposed works. The Council would request that all works are undertaken with due regard to highway safety and the free flow of traffic and pedestrians. Any temporary traffic management measures required during the installation works should be agreed with the Highway Authority where necessary. For the avoidance of doubt, this response is provided in relation to the Regulation 5 notification and should not be taken as a formal determination of lawfulness. Should you require a formal determination, a Certificate of Lawfulness application under Section 192 of the Town and Country Planning Act 1990 would need to be submitted.
