Under Section 96A of the Town and Country Planning Act 1990 (as amended), the drawings listed below are not acceptable as a non-material amendment to the development approved under planning permission reference 25/00478/HHFUL. -Proposed Rear Elevation (Received: 02 July 2026) -Proposed Front Elevation (Received: 02 July 2026) The proposed non-material amendment would alter the external appearance of the entire dwelling, as it seeks to render the whole property. Assessment The application seeks a non-material amendment to planning permission 25/00478/HHFUL, which granted consent for a two-storey side extension and single-storey rear extension in matching brick. The amendment proposes to render the entire dwelling, including the approved extensions, rather than retain the approved brick finish. Section 96A of the Town and Country Planning Act 1990 enables a Local Planning Authority to make changes to a planning permission where those changes are considered to be non-material. There is no statutory definition of a non-material amendment, and each case must be considered on its individual merits and in the context of the original planning permission. In assessing whether an amendment is non-material, it is necessary to consider the scale and nature of the proposed changes against the approved development. Planning permission 25/00478/HHFUL granted a two-storey side extension and single-storey rear extension, with external materials approved as brick to match the existing dwelling. The approved drawings clearly show the extent of the development and its associated finishes. The amendment extends beyond the scope of the approved development by proposing alterations to the external finish of the entire dwelling, rather than solely the approved extensions. Rendering the entire property would substantially change its appearance from the approved scheme and would affect elements of the dwelling that do not form part of the development authorised under planning permission 25/00478/HHFUL. The proposal would result in a visual change to the host dwelling through the replacement of the existing brick finish with render across the whole building. Officers consider that this is more than a minor alteration to the approved development. The proposed changes would materially alter the external appearance and character of the dwelling and would therefore exceed what could reasonably be regarded as a non-material amendment. The amendment would not simply modify details of the approved extensions but would introduce a wider alteration to the existing property that was not assessed as part of the original planning application (ref. 25/00478/HHFUL). Conclusions: For the reasons set out above, the Local Planning Authority concludes that the proposed amendments would result in a material change to the external appearance of the dwelling and would extend beyond the development approved under planning permission 25/00478/HHFUL. The proposal therefore fails to meet the requirements of Section 96A of the Town and Country Planning Act 1990 and cannot be regarded as a non-material amendment. Accordingly, the application is refused. Should the applicant wish to undertake the rendering of the entire dwelling, a separate planning application will need to be submitted for the Local Planning Authority's consideration.
