- The Local Planning Authority is not satisfied, on the balance of probability, that the proposed use of the external areas of the site for approximately 39 storage containers would remain ancillary to the established lawful use of the site. The submitted evidence indicates that the external land has historically functioned primarily as ancillary operational space, including parking, circulation and servicing associated with the principal building. The proposal would result in the extensive use of external land for storage purposes and would materially alter the character and function of that land. Accordingly, the applicant has failed to demonstrate that the proposal would not constitute a material change of use requiring planning permission pursuant to Section 55 of the Town and Country Planning Act 1990. The proposal has therefore not been demonstrated to be lawful for the purposes of Section 192 of the Town and Country Planning Act 1990. On this basis the application for a Lawful Development Certificate for Proposed Used is refused.
