Having considered the submitted information, and the information contained within the Council's own records, there are no records of the application site being used in any other class other than a residential care home facility as per planning permission 96/P0525 which allowed the site to be changed from its previous use as a Guest House to a Residential Home. Although there is insufficient information to confirm that the C2 use has been in place prior to the expiry of the planning permission, the LPA are content that sufficient evidence has been provided to confirm the use has been in place since at least 2006, and as such, the site has been operating as C2 use for the past 20 years. Having considered the information available, on the balance of probability, the existing development as shown on the submitted plans and the supporting information provided, it is likely that the site has been in operation as C2 use for the past 20 years and lawful as per the applicant's statement. In accordance with Section 191 of the Town and Country Planning Act 1990 (as amended) the Local Planning Authority should issue a Certificate of Lawfulness of Existing Development to confirm this building has operated as C2 use class for the past 20 years, since 2006. The existing use class C2 use is therefore lawful.
