Post remediation sampling and monitoring results shall be included in the report to demonstrate that the required remediation has been fully met. Future monitoring proposals and reporting shall also be detailed in the report. As such, the detail submitted is deemed acceptable for the Local Planning Authority to discharge the condition. It is noted that Pollution Control have advised: This response is made on the understanding that the responsibility for providing information on whether the site is contaminated rests primarily with the developer; where Planning Permission is granted for a site on which the presence of contamination is known or suspected, the responsibility for safe development and secure occupancy of the site rests with the developer; and that the response has been determined on the basis of the information available, but this does not mean that the land is free from contamination. Conclusion: The details submitted relating to condition 12 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition. Condition 12 is hereby discharged in relation to Plots 364-369.
