Under Section 96A of the Town and Country Planning Act 1990 (as amended), the revised drawings listed below are not acceptable as a non-material amendment to the development approved under planning permission reference 24/00535/REM. - Planning Drawing Corner (Render) - 22-242-01-RF_S802-P01) - Planning Drawing Corner (Brick) - 22-242-01-0801-P02 The non-material amendment as shown on the above drawings would permit an amendment as follows: • Alterations to the position, size and number of windows within the side elevation of the Type 13.0 corner turner house type. • The removal of the previously approved three windows (serving the kitchen/diner and bedrooms 3 and 4) and their replacement with two windows of varying design, serving the ground floor kitchen/diner and first floor bathroom. • On drawing 22-242-01-0801-P02 only, the introduction of an additional window within the rear elevation serving bedroom 3, which is not reflected on drawing 22-242-01-RF_S802-P01. Assessment Officers have reviewed the non-material amendment and, consider that the proposed changes would materially alter the appearance of the dwelling and its contribution to the street scene. The approved corner turner house type occupies a prominent position within the streetscape, where elevations are highly visible and play an important role in providing visual interest and active frontages. The removal of one of the previously approved windows, along with the redistribution of the remaining openings, would result in a more limited and less balanced fenestration pattern. This would create a less visually interesting elevation and introduce a more blank and inactive façade when viewed from the public realm. Furthermore, the proposed variation in window size and design between ground and first floor levels would result in a discordant and visually unbalanced appearance. This lack of cohesion in the elevational design is considered to result in poor architectural quality and would detract from the overall character and appearance of the development. In addition, drawing 22-242-01-RF_S802-P01 indicates that Bedroom 3 would no longer be served by a window. This would result in a materially harmful impact on the amenity of future occupants, by failing to provide adequate natural light and outlook to a habitable room. There is also an inconsistency between the submitted drawings, with drawing 22-242-01-0801-P02 showing an additional rear window serving Bedroom 3 that is not reflected on drawing 22-242-01-RF_S802-P01. This creates further uncertainty regarding the extent and implications of the proposed amendments. For the reasons outlined above, the proposed amendments are considered to materially alter both the appearance of the dwelling and its contribution to the street scene. As such, they do not fall within the scope of a non-material amendment under Section 96A.
