  1. Having considered the submitted information, it is considered that the proposed development of Class E(e) would fall within Class E of Part A of Schedule 2 of the Town and Country Planning (Use Classes) Order 1987 (as amended). As the proposed use class is within the same use class as the lawful use of the existing site and the internal alterations do not require planning permission, therefore the proposed development would not constitute a material change of use under the provisions of Section 55 of the Town and Country Planning Act 1990 (as amended). As such, the proposed change of use from Use Class E(g)(i) to Use Class E(e) does not require the express benefit of planning permission and is therefore defined as lawful.
