  1. Having assessed the supporting information, including a personal statement from the applicant, it is considered that the proposed unit would be classed as a caravan or mobile home, as per the Caravan Sites and Control of Development Act 1960 as modified by the Caravan Sites Act 1968. Furthermore, on the balance of probabilities, the unit would remain ancillary to the occupation of the existing dwellinghouse. Accordingly, the stationing of the mobile home (garden annexe) within the residential curtilage would not result in the creation of a separate planning unit or a material change of use of the land. As such, the proposal would not constitute development requiring planning permission. The case officer recommends that Certificate of Lawfulness (Proposed) is LAWFUL.
