The proposal as submitted was not in accordance with local and national planning policy. The local planning authority have worked with the applicant in a positive and proactive manner based on seeking solutions to problems arising in relation to dealing with the planning application. Amendments were discussed and agreed with the applicant to bring the proposal into compliance with policy, and the application can therefore be approved in accordance with Paragraph 38 of the National Planning Policy Framework (2024).
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended).
The materials to be used in the construction of the external surfaces of the developments hereby permitted shall match those on drawings ‘Proposed Elevations’ (Drawing Number: 006A and 007A) dated 07 April 2026. Reason: For the Local Planning Authority to ensure a satisfactory external appearance, in accordance with accordance with Policy LP16 and LP19 of the Peterborough Local Plan (2019) the provisions of the NPPF 2024.
The development hereby permitted shall be carried out in accordance with the following plans: -Location Plan (Drawing Number: 001) -Proposed Block Plan (Drawing Number: 005) -Proposed Elevations (Drawing Number: 006A) -Proposed Elevation (Drawing Number: 007A) Reason: For the avoidance of doubt and proper planning.
The development shall be carried out in accordance with the submitted report titled ‘BS5837:2012 - Trees in relation to design, demolition and construction. Arboricultural matters in relation to a Horse Chestnut at Lincoln gate Care Home, Peterborough from East Midlands Tree Surveys Ltd’ dated 20th May 2026. No trees, shrubs or hedges within the site which are shown as being retained on the approved plans shall be felled, uprooted, wilfully damaged or destroyed, cut back in any way or removed without the prior written consent of the Local Planning Authority: any trees, shrubs or hedges removed without such consent, or which die or become severely damaged or seriously diseased within 5 years from the completion of the development hereby permitted shall be replaced with trees, shrubs or hedge plants of similar size and species unless the Local Planning Authority gives written consent to any variation. Reason: In order to protect the existing tree, cover on site, in accordance with Policy LP29 of the Peterborough Local Plan (2019) and Chapter 15 of the National Planning Policy Framework (2024).
