C3: Prior to installation and operation details of the make, model, location, sound power level and frequency spectrum data of any mechanical plant shall be submitted to and approved in writing by the Local Planning Authority. The information will demonstrate that the mechanical plant is in compliance with the noise levels specified in condition above. Thereafter the development shall be implemented in accordance with the approved details, including any necessary mitigation, and shall thereafter be retained and maintained as such in perpetuity. Reason: In the interests of protecting future occupier residential amenity in accordance with Policy LP17 of the Peterborough Local Plan 2019 and paragraph 1879e) of the National Planning Policy Framework 2024. Plans and documents submitted in support of the discharge of C3: - Building Services Noise Impact Assessment (Ref. OP-B956 - AC - 6v4). Assessment: The submitted noise impact assessment outlines that the cumulative daytime level for NSR 3 is 27dB LAtr. Therefore, all plant equipment would be within an acceptable parameter. The make, model, location and noise related data are also acceptable to the LPA. The use of Air Source Heat Pumps is welcomed. The City Council's Pollution Control Officer has no objection. However, it is important to note that compliance within the acceptable noise limits rests with the developer and secured under Condition C2 of the parent permission. The proposal is considered to be acceptable to the Local Planning Authority. The requirements of C3 have been met. Conclusion: The details submitted relating to condition 3 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition. Condition 3 is hereby discharged, subject to implementation in accordance with the approved details.
C2: The rating level of noise emitted from the site shall not exceed 35dB LAeq, 1 hour between 07.00hrs and 23.00hrs, and 26dB LAeq, 15 minutes at any other time. The noise levels should be determined at the nearest noise sensitive premises. The measurements and assessment should be made according to BS:4142:2014. Reason: In the interests of protecting future occupier residential amenity in accordance with Policy LP17 of the Peterborough Local Plan 2019 and paragraph 187(e) of the National Planning Policy Framework 2024. Assessment: Conditon 2 is a compliance condition therefore cannot be formally discharged. The contents of such support the long term operation of the site in line with the details secured under conditon 3.
