Condition 8 - Remediation Scheme Prior to the commencement of development a remediation scheme specifying the measures to be taken to remediate the site to render it suitable for the development hereby permitted shall be submitted to and approved in writing by the local planning authority. The site shall be remediated in accordance with the approved measures before development begins. On completion of measures identified in the approved remediation scheme, a validation report (that demonstrates the effectiveness of the remediation carried out) must be submitted to the Local Planning Authority. Reason: In order to ensure that contamination is appropriately characterised and remediated in the interests of groundwater quality and human health, in accordance with Policy LP33 of the adopted Peterborough Local Plan. This is a pre-commencement condition as ground conditions must be remediated in advance of other below ground works commencing. As such, the detail submitted is deemed acceptable for the Local Planning Authority to discharge the condition. It is noted that Pollution Control have advised: This response is made on the understanding that the responsibility for providing information on whether the site is contaminated rests primarily with the developer; where Planning Permission is granted for a site on which the presence of contamination is known or suspected, the responsibility for safe development and secure occupancy of the site rests with the developer; and that the response has been determined on the basis of the information available, but this does not mean that the land is free from contamination. Conclusion: The details submitted relating to condition 8 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition. Condition 8 is hereby discharged.
