This application seeks to formally discharge Schedule 1, Clause 1 of the Planning Agreement made pursuant to Section 106 of the 1990 Act (as amended) dated 18th December 2023 between (1) Peterborough City Council, (2) Christopher James Cutteridge, (3) Royal Society for the Prevention of Cruelty to Animals & The Peoples Dispensary for Sick Animals & Charles John Urquhart Applegate, (4) Allison Homes Limited. Schedule 1, Clause 1 states ‘There shall be no Implementation unless and until the Affordable Housing Scheme has been approved by the Council and thereafter the Affordable Housing Scheme shall be complied with in full unless the Council agrees otherwise in writing’. For clarity the definitions of the terms above are: Affordable Housing Scheme: means a detailed scheme approved by the Council for the provision of Affordable Housing on the Development which includes a timetable and programme for its implementation and a timeframe for offering the Affordable Housing to a Registered Provider such Affordable Housing Scheme to comprise not less than 30% in total of all dwellings comprising a mix of housing including Affordable Rented Housing and Shared Ownership Housing and which scheme may be amended from time to time with the Councils written approval. Assessment: The City Council's Housing Strategy Officer has reviewed the information submitted in relation to the application to discharge the Affordable Housing Scheme Obligation from the S106 Agreement and confirms the 80 identified s106 affordable housing units that comprise the affordable housing scheme are in accordance with the planning obligations. This breakdowns into 56 units as Affordable Rented Tenure and 24 Shared Ownership. Alison Homes have confirmed the timetable and programme for it's implementation, which is considered acceptable. Conclusion: Peterborough City Council, as Local Planning Authority for the area within which the land the subject of the Planning Obligation is situated hereby approves the details required by Schedule 1, Clause 1.
