The proposal as submitted was not in accordance with local and national planning policy. The local planning authority have worked with the applicant in a positive and proactive manner based on seeking solutions to problems arising in relation to dealing with the planning application. Amendments were discussed and agreed with the applicant to bring the proposal into compliance with policy, and the application can therefore be approved in accordance with Paragraph 38 of the National Planning Policy Framework (2024).
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended).
The materials to be used in the construction of the external surfaces of the developments hereby permitted shall match those on drawings ‘Front Outbuilding – Front Ancillary Storage’ (indexed on 16 June 2026) and ‘Rear Outbuilding – Rear Gym Plans’ (dated 22 April 2026). Reason: For the Local Planning Authority to ensure a satisfactory external appearance, in accordance with accordance with Policy LP16 and LP19 of the Peterborough Local Plan (2019) the provisions of the NPPF 2024.
The development hereby permitted shall be carried out in accordance with the following plans: - Location Plan (dated 14 April 2026) - Proposed Block Plan (dated 15 June 2026) -Front Outbuilding – Front Ancillary Storage (indexed 16 June 2026) -Rear Outbuilding – Rear Gym Plans (dated 22 April 2026) Reason: For the avoidance of doubt and proper planning.
The development shall be carried out in accordance with the submitted Proposed Block Plan (dated 15 June 2026) and the Updated Construction Methodology & Tree Mitigation Statement (dated 15 May 2026). No trees, shrubs or hedges within the site which are shown as being retained on the approved plans shall be felled, uprooted, wilfully damaged or destroyed, cut back in any way or removed without the prior written consent of the Local Planning Authority: any trees, shrubs or hedges removed without such consent, or which die or become severely damaged or seriously diseased within 5 years from the completion of the development hereby permitted shall be replaced with trees, shrubs or hedge plants of similar size and species unless the Local Planning Authority gives written consent to any variation. Reason: In order to protect the existing tree cover on site, in accordance with Policy LP29 of the Peterborough Local Plan (2019) and Chapter 15 of the National Planning Policy Framework (2024).
The outbuildings hereby permitted shall not be occupied or used at any time other than for purposes ancillary to the residential use of the dwelling known as 106 Oundle Road and shall not be occupied, leased or rented as a separate dwelling. Reason: This development is only acceptable as ancillary accommodation, in accordance with Policy LP34 of the Peterborough Local Plan 2019.
The existing side storage building shall be permanently removed from the site upon implementation of the approved new storage structure. No reinstatement of the removed building shall occur without the prior written approval of the Local Planning Authority. Reason: To ensure the removal of redundant structures and to preserve the character, appearance and setting of the Listed Building, in accordance with Policy LP16 and LP19 of the Peterborough Local Plan (2019) the provisions of the NPPF 2024.
