Planning conditions
  1. Subject to the imposition of the attached conditions, the proposal is acceptable having been assessed in the light of all material considerations, including weighing against relevant policies of the development plan.
  2. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended).
  3. The development hereby permitted shall be carried out in accordance with the following approved plans: - Site Location Plan (Drawing Number: 001 Rev P1) - Proposed Site Plan (Drawing Number: FRNT-25.565-270 Rev P2) - Proposed Basement and Ground Floor Plans (Drawing Number: FRNT-25.565-250 Rev P7). - Proposed First and Second Floor Plans (Drawing Number: FRNT-25.565-251 Rev P7) - Proposed Third and Fourth Floor Plans (Drawing Number: FRNT-25.565-252 Rev P6) - Existing and Proposed North Elevations (Drawing Number: FRNT-25.565-265 Rev P5) - Existing and Proposed East Elevations (Drawing Number: FRNT-25.565-268 Rev P4) - Existing and Proposed West Elevations (Drawing Number: FRNT-25.565-266 Rev P4) - Existing and Proposed South Elevations (Drawing Number: FRNT-25.565-267 Rev P3) - Existing and Proposed Site Section A-A (Drawing Number: FRNT-25.565-275 Rev P2) - Existing and Proposed Site Section B-B (Drawing Number: FRNT-25.565-276 Rev P1) Reason: For the avoidance of doubt and in the interest of proper planning
  4. No development other than groundworks and foundations shall take place unless and until details of all external materials have been submitted to and approved in writing by the Local Planning Authority. The details submitted for approval shall include the name of the manufacturer, the product type, colour (using BS4800) and reference number. The development shall not be carried out except in accordance with the approved details. Reason: For the Local Planning Authority to ensure a satisfactory external appearance, in accordance with Policy LP16 of the Peterborough Local Plan (2019) and Chapter 12 of the National Planning Policy Framework (2024). The condition is pre-commencement as it would be unreasonable to require applicants to undertake this work prior to consent being granted and the details need to be agreed before construction begins.
  5. Notwithstanding the submitted details, prior to the residential occupation of the development a scheme for soft landscaping of the site should be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the following:- - Proposed finished ground and building slab levels - Planting plans including retained trees, species, numbers, size and density of planting - An implementation programme (phased developments only) - Proposed planting plans including trees, species, numbers, size and density - Position, type and recommended number of any biodiversity enhancements The soft landscaping should be carried out within the first available planting season following completion of the development or first occupation (whichever is the sooner) or alternatively in accordance with a timetable for landscape implementation which has been approved as part of the submitted landscape scheme. Development should be carried out in accordance with the submitted details. Any trees, shrubs or hedges forming part of the approved landscaping scheme that die, are removed or become diseased within five years of the implementation of the landscaping scheme shall be replaced during the next available planting season by the developers, or their successors in title with an equivalent size, number and species to those being replaced. Any replacement trees, shrubs or hedgerows dying within five years of planting shall themselves be replaced with an equivalent size, number and species. Reason: In the interests of visual amenity of the area and the enhancement of biodiversity, in accordance Policies LP16, LP28 and LP29 of the Peterborough Local Plan (2019) and Chapters 12 and 15 of the National Planning Policy Framework (2024). The condition is pre-commencement as it would be unreasonable to require applicants to undertake this work prior to consent being granted and the details need to be agreed before construction begins.
  6. Prior to the first occupation of the residential accommodation and of the commercial unit(s) hereby permitted, and thereafter, a Waste Collection Strategy must be submitted to and approved in writing by the Local Planning Authority. The strategy shall demonstrate how waste collection operations will operate on the development and shall include but not be limited to: (i) Heads of Terms of a Commercial Waste Collection contract to be entered into by the developer or their agent, or confirmation that the Local Authority will be responsible for waste collections (ii) Frequency of waste collections, such frequency to be not less than twice weekly (can amend) (iii) Management of refuse bins prior to, during and following each collection (iv) Onsite recycling facilities to be provided. The development shall thereafter be undertaken and retained in accordance with the approved Waste Collection Strategy. Reason: In accordance with the requirements set out at Appendix E of the Adopted Peterborough Local Plan (2019) and the provisions of the National Planning Policy Framework (2024).
  7. Prior to the first occupation of the development a full travel plan shall be submitted to and approved in writing by the Local Planning Authority. The travel plan shall be written in accordance with current industry best practice including guidance of the Department of Transport. The development shall thereafter be occupied/operated in accordance with the approved travel plan or a plan as subsequently modified and approved in writing by the Local Planning Authority. Reason: In the interests of promoting sustainable transport and development, in accordance with Policy LP13 of the Peterborough Local Plan (2019) and Chapter 9 of the National Planning Policy Framework (2024).
  8. Prior to the first occupation or commencement of use, details of the type of cycle storage to accommodate cycles shall be submitted and agreed in writing with the Local Planning Authority. This area shall thereafter be retained for the purposes of cycle parking in connection with the development in perpetuity. Reason: In the interests of sustainable modes of transport, in accordance with Policy LP13 of the Peterborough Local Plan (2019) and Chapter 9 of the National Planning Policy Framework (2024). This is a pre-commencement condition to ensure the delivery of on-site secure cycle parking provision.
  9. No development above slab level shall take place until details of a rainwater harvesting scheme have been submitted to and approved in writing by the Local Planning Authority. The details shall demonstrate how rainwater will be captured, stored, reused, and maintained and shall be in accordance with the principles set out on drawing FRNT-25.565-251 Rev P7. The approved rainwater harvesting system shall be implemented prior to first occupation of the development and shall thereafter be retained and maintained for the lifetime of the development. Reason: To promote sustainable water management, reduce potable water demand, and support the effective management of surface water runoff in accordance with Policy LP32 of the Peterborough Local Plan (2019) and Chapter 14 of the National Planning Policy Framework (2024). The condition is pre-commencement as it would be unreasonable to require applicants to undertake this work prior to consent being granted and the details need to be agreed before construction begins.
  10. Prior to occupation, written confirmation from Anglian Water must be submitted confirming there is sufficient headroom at the water recycling centre to accommodate the foul flows from the development site. This condition shall cease to have effect if development is first occupied after April 2030. Reason: To protect water quality, prevent pollution and secure sustainable development having regard to paragraphs 7/8 and 187 of the National Planning Policy Framework (2024).
  11. No development shall commence until a strategic foul water strategy has been submitted to and approved in writing by the local Planning Authority, in consultation with Anglian Water. This strategy will identify a sustainable point of connection to the public foul network. Prior to occupation, the foul water drainage works must have been carried out in complete accordance with the approved scheme. Reason: To protect water quality, prevent pollution and secure sustainable development having regard to paragraphs 7/8 and 180 of the National Planning Policy Framework (2024).
  12. Prior to installation and occupation, a glazing scheme shall be submitted to and approved in writing by the Local Planning Authority. Where overheating is an issue, the scheme shall be developed in accordance with the Approved Doc O and where appropriate the Acoustic Ventilation and Overheating Residential Design Guide. Thereafter the development shall be implemented in accordance with the approved details and shall thereafter be retained and maintained as such in perpetuity. Reason: To safeguard the future occupier amenity of the residents, in accordance with Policy LP17 of the Peterborough Local Plan (2019) and the National Planning Policy Framework (2024).
  13. Prior to occupation and use the floor between the ground floor commercial unit and the residential premises shall be tested to ensure that it equates to a level of DnT,w + C’tr $448dB. Should the floor be below the required standard a scheme shall be submitted to the LPA for approval in writing to bring the sound reduction index of the floor into compliance. Thereafter the development shall be implemented in accordance with approved details and thereafter be retained and maintained in perpetuity. Reason: To safeguard the future occupier amenity of the residents, in accordance with Policy LP17 of the Peterborough Local Plan (2019) and the National Planning Policy Framework (2024).
  14. Where appropriate the scheme shall comply with Approved Document F, Approved Doc O, and the Acoustic Ventilation and Overheating Residential Design Guide for design and acoustic specification purposes.
  15. The ground floor shall be used as Class E (a), (b), (c), (e) and (g) only and for no other purpose (including any other purpose within Class E, specifically (d) and (f) of the Schedule to the Town & Country Planning (Use Classes) Order 1987) (or any provision equivalent to that class in any statutory instrument revoking and re-enacting that Order with or without modification), notwithstanding the provisions of the Town & Country Planning (General Permitted) Development Order 1995 (or any statutory instrument revoking and re-enacting that Order). Reason: To safeguard the future occupier amenity of the residents, in accordance with Policy LP17 of the Peterborough Local Plan (2019) and the National Planning Policy Framework (2024).
  16. Prior to installation and operation details of the make, model, location, sound power level and frequency spectrum data of any mechanical plant shall be submitted to and approved in writing by the Local Planning Authority. The information will demonstrate that the rating level of the mechanical plant is 5dB(A) below the background noise level. The measurements and assessment shall be made according to BS:4142:2014. Thereafter the development shall be implemented in accordance with the approved details, including any necessary mitigation, and shall thereafter be retained and maintained as such in perpetuity.
