Planning conditions
  1. Subject to the imposition of the attached conditions, the proposal is acceptable having been assessed in the light of all material considerations, including weighing against relevant policies of the development plan.
  2. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended).
  3. The development hereby permitted shall be carried out in accordance with the following approved plans: Proposed site plan 251_A_003 Location Plan Rev B 251_A_001 Proposed ground floor plan 251_A_102 Proposed first floor plan 251_A_103 proposed elevations Rev C 251_A_401 Reason: For the avoidance of doubt and in the interest of proper planning
  4. The materials to be used in the construction of the external surfaces of the proposed hereby permitted shall be as detailed in plan ‘Proposed elevations Rev C 251_A_401’ Reason: For the Local Planning Authority to ensure a satisfactory external appearance, in accordance with Policy LP16 of the Peterborough Local Plan (2019) And section 12 of the NPPF (2024).
  5. Use of thetakeaway use hereby approved shall only occur between 11:00 to 00:00 Monday – Friday and 11:00-01:00 Saturdays The takeaway shall not be used outside of these specified times. Reason: In order to protect the amenity of the area in accordance with Policy LP17 of the Peterborough Local Plan (2019) and paragraph 198 of the National Planning Policy Framework (2024).
  6. Prior to the commencement of the takeaway use hereby permitted a scheme detailing the measures to be incorporated into the system to control the emissions of noise and odour shall be submitted to, and approved in writing by the Local Planning Authority. Once approved, the measures shall take be fitted and managed in accordance with the scheme and no deviation shall take place without the prior written approval of the Local Planning Authority. Reason: To protect neighbouring amenity in accordance with Policy LP17 of the Peterborough Local Plan (2019) and paragraph 198 of the National Planning Policy Framework (2024).
  7. Prior to the first occupation or commencement of use, The cycle parking shall be laid out and completed in accordance with drawing -Proposed ground floor plan 251_A_102 and retailed in perpetuity. Reason: In the interests of highway safety and to encourage travel by sustainable modes, in accordance with Policy LP13 of the Peterborough Local Plan (2019) and Paragraph 115 of the National Planning Policy Framework 2024.
  8. Prior to the first occupation or commencement of use, The bin storage arrangements hereby approved shall be laid out and completed in accordance with drawings: Proposed ground floor plan 251_A_102 ‘ Proposed elevations Rev C 251_A_401’ and retailed in perpetuity. Reason: In the interests of highway safety in accordance with Policy LP13 of the Peterborough Local Plan (2019) and the provisions of the NPPF (2024)
