Planning conditions
  1. Condition 10 No dwelling shall be occupied until the vehicle access linking that dwelling to the public highway has been completed to a minimum of base course level and any shared surface areas and footways serving that dwelling have been completed to surface course level. In the event the dwelling is occupied with the roads at base course level then a timetable and phasing plan for completing the roads shall be submitted to and approved in writing by the Local Planning Authority. The roads shall thereafter be completed in accordance with the approved timetable and phasing plan. Reason: In the interests of highway safety in accordance with Policy LP13 of the Peterborough Local Plan (2019) and Chapter 9 of the National Planning Policy Framework (2024). Plans and documents submitted in support of the discharge of C10: - Road Topping Phasing Plan S100_100 B Assessment: Drawing S100_100 B Road Topping Phasing Plan illustrates the timetable and phasing for the completion of the roads should this not occur prior to occupation - it should be noted that to allow ocucpation all roads serving the properties must be completed to base course level. The drawing includes a programme running until October 2029. The Local Highway have no objection to the programme presented on the revised drawing Phasing Plan S100_100 B. The drawing has a number of notes, Officers draw attention to the fact that Notes 2 and 3 are not accepted by the Planning Authority. The Phasing dates as per the plan are what Officers are assessing the application on and deviation from this would require another formal discharge. In addition, finished tarmac surfacing must be in accordance with the phasing, if the works cannot be carried out in months from October-March, then the plan must be revised. Conclusion: The requirements of Condition 10 have been met and therefore Condition 10 is discharged.
  2. Condition 12: Prior to the first occupation a methodology for the monitoring of vehicle speeds on the EastWest Link Road shall be submitted to and agreed in writing with the Local Planning Authority. The monitoring shall be carried out in accordance with the agreed methodology and the results of the monitoring shall be submitted to the Local Planning Authority. If the results illustrate mitigation is required, a mitigation strategy, including timescales of implementation shall be submitted to and agreed in writing with the Local Planning Authority. Any mitigation measures must be implemented in accordance with the approved scheme and timescales. Reason: In the interest of highway safety in accordance with LP13 of the Peterborough Local Plan (2019) and Chapter 9 of the National Planning Policy Framework (2024), as the Stage 1 RSA flagged a risk with the road alignment and vehicular speeds. The condition allows for ongoing monitoring of the road and retrospective mitigation if required. Plans and documents submitted in support of the discharge of C12: - Vehicle Speed Monitoring Technical Note 01 (dated July 2026) Assessment: The Local Highway Authority were satisfied with the monitoring plan outlined in the technical note. At this point, the submission has fulfilled the first part of the condition by setting out the methodology and timescales of how the road will be monitored. The condition can only be fullfilled and fully discharged once the monitoring period is complete and if required, mitigation has been implemented. The LPA expect the subseuqent discharged of Condition 12 for the monitoring reports. Conclusion: Therefore, the first requirement of Condition 12 has been fulfilled and the condition can be partially discharged.
  3. Condition 15: Prior to the first occupation a glazing scheme shall be submitted to and approved in writing by the Local Planning Authority. Where overheating is an issue, the scheme shall be developed in accordance with the Approved Doc O and where appropriate the Acoustic Ventilation and Overheating Residential Design Guide. Thereafter the development shall be implemented in accordance with the approved details, prior to the occupation of any unit to which it relates and shall thereafter be retained and maintained as such in perpetuity. Advisory: Closed windows and a southerly orientation signify that the impacts of overheating are of concern. Glazing and ventilation both influence the extent of overheating therefore the glazing scheme shall be considered in conjunction with the ventilation scheme. Reason: To ensure an acceptable level of amenity for future occupiers and prevent the need for occupiers to choose between thermal or acoustic comfort, in accordance with Policy LP17 of the Peterborough Local Plan (2019) and 187 (e) of the National Planning Policy Framework (2024). Plans and documents submitted in support of the discharge of C15: - Supporting Commentary dated 12th August 2026 - Acoustic Specification GC windows - Dynamic Overheating assessments for all house types Assessment: The GC Windows Ltd document states that their standard glazing which is to be used across the scheme has a sound reduction index of 30dB Rw +Ctr. This is acceptable to Environmental Health. Conclusion: Therefore, the requirements of Condition 15 have been fulfilled and the condition is discharged.
  4. Condition 16: Prior to occupation and use, a scheme which specifies the provisions for ventilation of the development shall be submitted to and approved in writing by the local planning authority. Where appropriate the scheme shall comply with Approved Document F, Approved Doc O, and the Acoustic Ventilation and Overheating Residential Design Guide for design and acoustic specification purposes. Thereafter the development shall be implemented in accordance with the approved details, prior to the occupation of any unit to which it relates and shall thereafter be retained and maintained as such in perpetuity. Advisory: Closed windows and a southerly orientation signify that the impacts of overheating are of concern. Glazing and ventilation both influence the extent of overheating therefore the glazing scheme shall be considered in conjunction with the ventilation scheme. Plans and documents submitted in support of the discharge of C16: - Acoustic Specification GC windows - Dynamic Overheating Assessments for all house types - Great Haddon Ventilation Calculations - Supporting Commentary - NBR CoolBox Kits - Specfication Data Sheet - Haversham Ventilation - Link Vent 500 Assessment: For trickle vents the GC Windows Ltd document has provided details of products that meet the acoustic requirements. The developer shall ensure that the scheme meets the requirements of the acoustic report and Approved Doc F. The applicant has advised that NBR Vent Axia Cool Box Kits shall be used to mitigate the overheating condition. The self-made noise produced depends on the flow rate required, and as previously stated the TM59 summary states this ranges from 25l/s to 60l/s. The break-in noise via any vents shall also require consideration and control. The details provided are acceptable to Environmental Health, providing they adhere to details provided, such as the developer shall ensure that the flow rate meets the requirements of the TM59 report, and that noise from any mechanical system is effectively controlled, so that it does not discourage occupants from using that system. The AVO Guide sets out recommended noise levels attributable only to mechanical services, as detailed in Table 2, although these are not formally required to comply with AD-O. Conclusion: Therefore, the details submitted have fulfilled Condition 16 and the condition is discharged.
  5. Condition 17: Prior to occupation of the plots identified with rear curtilages at risk in Appendix C of the Spectrum Acoustics report ref:AP1983/24208/Rev 3 details of the rear boundary enclosures shall be submitted and agreed in writing with the Local Planning Authority. Those particular plots shall be protected with an appropriate height acoustic barrier, with a superficial mass of _$4 10kg/m2 and all gaps shall be sealed, including the area between the ground and the bottom of the barrier. Once installed the barrier shall be retained and maintained in perpetuity. All other plots not identified in Appendix C of the Spectrum Acoustics report ref:AP1983/24208/Rev 3 shall deliver the rear boundary enclosures in accordance with drawing n2359_700B. The boundary treatments shall be constructed prior to the occupation of the dwelling to which it relates and maintain in perpetuity. Reason: To ensure an acceptable level of amenity for future occupiers and visual appearance in the street scene, in accordance with Policy LP17 of the Peterborough Local Plan (2019) and 187 (e) of the National Planning Policy Framework (2024). Plans and documents submitted in support of the discharge of C17: - N2359 700E Enclosures Plan - Double Board Timber Fence - Boundary Wall Type 4 Plot 1 Assessment: Having reviewed the submitted enclosures plan, Officer's agree with Environmental Health that the proposed details are acceptable. The Spectrum Acoustics report ref:AP1983/24208/Rev 3 specifies '2.4m high screening to the garden of Plot 1 and 1.8m high screening to other relevant gardens', and 'acoustic screening must comprise a solid continuous screen, without penetrations, with a minimum mass per unit area of 10kg/m2, which must be maintained for the life of the screen. A closed boarded timber fence should be able to meet these criteria'. The applicant has provided details that appear to meet these requirements; therefore, the condition can be discharged. Conclusion: The details submitted relating to condition 17 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition. Condition 17 is hereby discharged, subject to implementation in accordance with the approved details.
  6. Condition 20: Prior to the occupation of 50% (158 units) of the development , the details of the marginal vegetation for the western and northern drainage channels shall be submitted to and approved in writing within the Local Planning Authority. The planting shall be delivered within the first available planting season following completion of the development or first occupation (whichever is the sooner). Development shall be carried out in accordance with the submitted details. Any species forming part of the approved landscaping scheme that die, are removed or become diseased within five years of the implementation of the landscaping scheme shall be replaced during the next available planting season by the developers, or their successors in title with an equivalent size, number and species to those being replaced. Any replacement trees, shrubs or hedgerows dying within five years of planting shall themselves be replaced with an equivalent size, number and species Reason: In the interests of visual amenity of the area and the enhancement of biodiversity, in accordance with Policies LP16, LP28 and LP29 of the Peterborough Local Plan (2019) and Chapter 15 of the National Planning Policy Framework 2024 Plans and documents submitted in support of the discharge of C20: - Soft Landscape Proposals GL2292 03E - Soft Landscape Proposals GL2292 05E - Soft Landscape Proposals GL2292 06E - Soft Landscape Proposals GL2292 07E - Soft Landscape Proposals GL2292 08E Assessment: The Wildlife Officer intially raised concern the detials did not present clarity on the northern and western drainage channels, as such revised landscaping plans were provided. These were found to be acceptable. Conclusion: The details submitted relating to condition 20 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition. Condition 20 is hereby discharged, subject to implementation in accordance with the approved details.
