Condition 35 - Discharge of Phase 3 Open Space Only No development, clearance works or remediation works shall take place within any parcel of land as identified on the approved Development Framework Plan (Plan no. PST021-DFP-101 Rev B) until up to date survey work for that parcel has been submitted to and approved in writing by the Local Planning Authority. The updated survey work shall be carried out in accordance with the methodology set out in the Biodiversity Strategy and the Great Crested Newt Strategy (as secured under the terms of conditions C34 and C33 respectively). Unless otherwise agreed with the Local Planning Authority, surveys shall be carried out for Great Crested Newts, Reptiles, Breeding Birds, Water Voles, Bats, Badgers, Brown Hairs, Butterflies/Moths. Aquatic and Terrestrial Invertebrates, and aquatic plants. If development does not thereafter commence within 2 years of the survey date, new surveys will need to be undertaken in accordance with the above process. Reason: In order to protect species within the development area from harm in accordance with National Planning Policy Framework, Policy CS21 of the adopted Peterborough Core Strategy DPD (2011) and the Conservation of Habitat and Species Regulations 2010. This is a pre-commencement condition to ensure that no development work takes place which may pose an unacceptable danger to protected species/ecology/biodiversity within the site. Plans and documents submitted in support of the discharge of C35: Biodiversity Statement Ecology Report Great Haddon Phase 3 Otter and Water Vole Survey Great Crested Newt Monitoring Report 2026 Assessment: Condition 35 was discharged for Phase 2 of the O Land under 24/00731/DISCHG. This application seeks to discharge C35 for Phase 3 but specifcally for the open space parcel (OS14) to the north of the O Land only. The Phase 2 Report has been resubmitted under this application along with supporting information as BSG was commissioned in May of 2023 to by O&H Properties Ltd to undertake an update surveys of the Phase 2 area, during which the entire area of Phase 3 (hereafter referred to as the Site) was surveyed between May 2023 and May 2024. It is recognised that original survey data is coming towards the end of its lifespan but given the further confirmation letter from the Ecologists, PCC Wildlife Officer is satisfied with that this remains appropraite for the area of land subject to this application. In addition, the application has been supported by an Otter and Water Vole Survey and Great Crested Newt Monitoring Report. As such, PCC Wildlife Officer considers sufficient information has been recieved to satisfy the requirements of C35 for Phase 3 Open Space only. However, prior to the submission of a discharge application for C33(a) for Great Crested Newt Monitoring the Wildlife Officer will reuqire the following addressed: 1. Only 4 out of the recommended and previously done 6 survey were completed in 2026. It appears that the survey timings did provide scope to complete all 6 surveys. The justification for only completing 4 surveys appears to be that they are just monitoring surveys. I do not think this provides enough detail or justification. 2. Pond C was specifically created as a compensation pond for Great Crested Newts it appears to be drying early in the year. I think we need to consider remediation works to ensure that the pond has a stable GCN population. Conclusion: The details submitted relating to condition 35 are deemed acceptable to the Local Planning Authority for Phase 3 Open Space and comply with the submission requirements of the condition. Condition 35 is hereby discharged for Phase 3 Open Space only, subject to implementation in accordance with the approved details.
