Planning conditions
  1. Condition 4 - Biodiversity net gain The development hereby permitted shall not begin unless and until a biodiversity net gain plan and updated biodiversity metric baseline has been submitted to and agreed in writing with by the Local Planning Authority which biodiversity net gain plan shall address the following matters: (a)information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat, (b)the pre-development biodiversity value of the onsite habitat, (c)the post-development biodiversity value of the onsite habitat, (d)any registered offsite biodiversity gain allocated to the development and the biodiversity value of that gain in relation to the development, (e)any biodiversity credits purchased for the development, and (f)such other matters as the Secretary of State may by regulations specify. Thereafter, the development shall be carried out in accordance with the agreed approved details. Reason: In accordance with the requirements of Schedule 14, Part 1 of paragraph 14 of the Environment Act 2021 and Policy LP28 of the Peterborough Local Plan (2019) and NPPF (2024). Plans & documents submitted in support of the discharge of C4: - Preliminary Ecological Appraisal and Biodiversity Assessment Thomas Deacon Academy Peterborough (Dated November 2024, Revision Final) - Biodiversity Net Gain Plan (Version 1.0; dated 15th February 2025) -Location, Site Plan, and Details (Drawing Number 24018-001-01, Revision D) -Biodiversity Net Gain Metric (Indexed on 20th March 2026) Assessment: The Wildlife Officer has reviewed the submitted information and determined that it is not sufficient to discharge this condition. The Case Officer agrees that the proposed biodiversity gain plan does not meet the requirements set out in Schedule 14 of the Environment Act 2021. A full biodiversity gain plan must be provided, as the baseline ecological information submitted does not constitute the formal plan required. The plan must detail how biodiversity impacts will be minimised, the pre and postdevelopment biodiversity values, any offsite biodiversity gains or biodiversity credits, and any other required information. A government template is available here: https://www.gov.uk/government/publications/biodiversity-gain-plan. As a result, the requirements of Condition C4 have not been met. Conclusion: The details submitted relating to Condition 4 are deemed not acceptable to the Local Planning Authority and do not comply with the submission requirements of the discharge of the condition. Condition 4 is hereby not discharged.
