Planning conditions
  1. Condition 10: Notwithstanding the details supplied as part of the submission, no development above DPC shall take place until details of the soft landscaping have been submitted and agreed in writing with the Local Planning Authority. The details should illustrate proposed planting plans, species, quantity and sizing of plants. The planting shall be delivered within the first available planting season following completion of the development or first occupation (whichever is the sooner). Development shall be carried out in accordance with the submitted details. Any trees, shrubs or hedges forming part of the approved landscaping scheme that die, are removed or become diseased within five years of the implementation of the landscaping scheme shall be replaced during the next available planting season by the developers, or their successors in title with an equivalent size, number and species to those being replaced. Any replacement trees, shrubs or hedgerows dying within five years of planting shall themselves be replaced with an equivalent size, number and species. Reason: In the interests of visual amenity of the area and the enhancement of biodiversity, in accordance with Policies LP16, LP28 and LP29 of the Peterborough Local Plan (2019) and Chapter 15 of the National Planning Policy Framework 2024. Plans and documents submitted in support of the discharge of C10: Revised Detailed Landscape Proposal Sheet 1 of 3 C-2180-05 Rev G Revised Detailed Landscape Proposal Sheet 2 of 3 C-2180-06 Rev G Revised Detailed Landscape Proposal Sheet 3 of 3 C-2180-07 Rev H Assessment: The landscaping masterplan on 24/00535/REM, included pockets of meadow grassland, trees and bulb planting all along the northern boundary of the site onto the open space. The provision of street trees was minimal and this is something which could have been increased, but largely the scheme presented a relationship between the built development and the open space. Revisions were made to the landscaping plans under this discharge application to ensure the principles on the plan under the reserved matters consent was carried through, however, these revisions have not sufficiently incorproated soft landscaping or carried through the tree planting as illustrated under the reserved matters application. For instance, no rear gardens include trees, which is disappointing given these help support amenity value and there are minimal street trees within the phase. In addition, the were clear opportunities for tree planting within swales and along highway verge that have been missed and would reduce the quality of the street scene. Opportunities for further street tree planting have been illustrated to the applicant. Issues were present with legibility of the species schedule on sheet 1 and therefore planting species could not be verified. Objections were recieved from the Wildlife Officer and Tree Officer regarding the proposed landscaping submission and the choice of non-native species or minimal tree planting. Objections were recieved from the Local Highway Authority regarding lack of clarity on which trees were within 4.5m of the highway and to include root barriers. The specification of the root barrier should also be clearly demonstrated. Conclusion: The details submitted relating to condition 10 are unacceptable to the Local Planning Authority and do NOT satisfy the requirements of the condition. Condition 10 is NOT discharged.
  2. Condition 11: Prior to the first occupation of any dwelling, a lighting scheme for the public and private roads/courtyards and on plot lighting shall be submitted to and approved in writing by the Local Planning Authority. The lighting scheme shall be implemented in accordance the approved details prior to the occupation of the dwelling to which the scheme relates. The applicant should note that for highway adoptable lighting:- 1)All Lighting should be designed using 4000K lighting units as per connected phases of the development, if there are any known bat roosts/activity in the area full survey details are to be provided. 2) The specification referred/designed to should be December 2024 not August 2024 as stated on the plan. 3) PCC preferred power supplies for adoption are via DNO rather than IDNO. IDNO connection may be acceptable only when it is not possible or practicable for DNO supplies to be provided, details of the IDNO to be provided in accordance with Appendix G of the street lighting specification. The locations of the public highway lighting has also been reviewed in terms of amenity of any nearby properties and Officers are satisfied the locations would not result in unacceptable light pollution or impact to future residents. In terms of on plot private lighting the model proposed is Green Lighting Stainless Steel PIR Wall Light GL203LU-6W. This will be present on all front elevations and rear lighting is an optional extra for all market dwellings but will be present on the affordable units. Elevational plans have been provided to show locations and these are acceptable. Conclusion: The details submitted relating to condition 11 are have not fulfilled the requirements of the condition. Details for the on plot lighting are deemed acceptable to the Local Planning Authority, however the lighting within the public highway and private courtyards is not acceptable. This requires further review. Condition 11 is hereby partially discharged, subject to implementation in accordance with the approved details.
