- The evidence demonstrates that the pre-commencement requirements of Conditions C4, C5, C7 and C9 were discharged by the Local Planning Authority on 15 July 2025, prior to the commencement of development. In the case of Condition C5, whilst the condition was only partially discharged, the Authority confirmed that the pre-commencement requirements had been satisfied, with the remaining obligations relating to implementation and monitoring following commencement. The submitted evidence further demonstrates that a material operation constituting commencement of development was undertaken on 21 July 2025, within the three-year period prescribed by Condition 1 of planning permission APP/J0540/W/21/3287810. Having regard to the evidence submitted, and on the balance of probabilities, the Local Planning Authority is satisfied that the pre-commencement conditions attached to planning permission APP/J0540/W/21/3287810 were discharged prior to commencement and that development was lawfully commenced within the period prescribed by Condition 1. The planning permission was therefore lawfully implemented and remains extant.
