Under Section 96A of the Town and Country Planning Act 1990 (as amended), the amendment to the condition is acceptable as a non-material amendment to the development approved under planning permission 25/01510/FUL. Condition 6 is set out below: The use hereby permitted shall take place only between the hours of 11:00- 23:00 Monday-Thursday, 09:00-23:00 on Friday- Saturday and 12:00-22:00 Sundays and Public Holidays. Reason: In order to protect the amenity of the area in accordance with Policy LP17 of the Peterborough Local Plan (2019) and paragraph 198 of the National Planning Policy Framework (2024). This non material amendment amends the permission to remove condition 6 for the following reasons: The removal of condition C6 pertaining to hours of use would allow Sessions House to function within the realms of the existing licence. Given that the established and lawful use on site (prior to the approval of 25/01510/FUL) was an unrestricted restaurant use, Officers consider that the proposed removal of the condition would not materially alter the impact of development over and above that created by the existing lawful use through noise, disturbance or other impacts. Accordingly, Condition 6 of the original permission (ref. 25/01510/FUL.) is hereby Removed.
