  1. Schedule 2, Part 3, Class Q(c) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) allows for the change of use of a building and any land within its curtilage from a use as an agricultural building to a use falling within Class C3 (dwellinghouses) of the Schedule to the Use Classes Order with any reasonably necessary building operations. The term ‘curtilage’ is further defined within Class X of Part 3, which states that curtilage means either the land immediately beside or around the building, closely associated with and serving the purposes of the building, or the land immediately beside or around the building no larger than the land area occupied by the building, whichever is the lesser. In this instance, the land area occupied by the existing building is approximately 1,074 square metres, whereas the proposed curtilage extends to approximately 1,875 square metres. The proposed curtilage exceeds the land area of the existing building and as such cannot meet the requirements of the definition set out in Class X. Accordingly, the change of use cannot does not comply with the provisions of Class X, Part 3, Schedule 2 of the General Permitted Development Order.
