  3. C2 The external finishes of the proposed development shall be carried out in accordance with the approved drawings; 2850-DTA-XX-ZZ-DR-A-1560 Revision P03, 2849-DTA-02-00-DR-A-1570 Revision P01, 2849-DTA-02-00-DR-A-1560 Revision P01, and 2849-DTA-02-00-DR-A-1560 Revision P01. Reason: In order to ensure the proposal does not result in an adverse design and character impact in accordance with Policy LP16 of the Peterborough Local Plan.
  4. C3 Prior to the completion of development, the reporting and submission of the final reports for the programme of archaeological works in accordance with the submitted Written Scheme of Investigation shall be submitted to and agreed in writing with the Local Planning Authority. Reason: In the interest of archaeological reporting in accordance with Policy LP19 of the Peterborough Local Plan (2019).
  5. C4 Notwithstanding the approved plans, the 4no car parking spaces serving the Class E commercial use shown on drawing ‘Proposed Site Plan’ 2849-DTA-XX-XX-DR-A-0350 Revision P02 shall be used as visitor car parking spaces and maintained as such thereafter. Reason: There is a presumption against car parking spaces for non-residential uses within the city centre, therefore the car parking spaces have been secured as general visitor parking spaces in accordance with Policy LP13 of the Peterborough Local Plan (2019).
  6. C5 Prior to the first occupation of the development hereby approved wayfinding and information/history board details shall be submitted to and agreed in writing with the LPA. The wayfinding and boards should look to highlight key areas of interest and the local history of the site. The approved layout shall be implemented prior to the first occupation of the development hereby permitted. Reason: In the interest of visual amenity and promoting a historic understanding of the site in accordance with Policy LP16 and LP19 of the Peterborough Local Plan (2019).
  7. C6 Prior to the occupation of the building to which the artwork relates, details of the artwork on the Proposed Elevations of Buildings 1,2 and 3 shall be submitted to and agreed in writing with the LPA. The details shall include the final design, colour, external finishes and materials to be used as well as a timetable for implementation. Once approved the artwork shall be implemented in accordance with the approved timetable. Reason: In the interest of visual amenity in accordance with Policy LP16 of the Peterborough Local Plan.
  8. C7 The development shall only be carried out in accordance with all of the recommendations for mitigation and compensation set out in the PEA and Bat Surveys (July 2023, Archer Ecology) which details the methods for maintaining the conservation status of Bats, Reptiles, Nesting birds, Badgers and Otters, unless otherwise approved in writing by the local planning authority or varied by a European Protected Species licence subsequently issued by Natural England. Reason: In order to protect ecology in and adjacent the application site in accordance with Policy LP28 of the Peterborough Local Plan (2019).
  9. C8 The approved wheel cleaning equipment as set out in the document ‘Condition C4 - Wheel Washing’ shall be provided onsite during the construction period. All vehicles leaving the site shall pass through the approved wheel cleaning equipment and enter the public highway free of debris. The wheel cleaning equipment shall be available at the start of construction and retained on site in full working order for the duration of the construction and conversion works. Reason: In the interest of highway safety, in accordance with Policy LP13 of the Peterborough Local Plan (2019).
  10. C9 The development shall be occupied/operated in accordance with the approved travel plan, Travel Plan - P251547_TR01A (May 2026) or a plan as subsequently modified and approved in writing by the Local Planning Authority. Each flat shall have a Sustainable Travel Information Pack (STIP) available prior to occupation. The STIP must comply with the visions of the Travel Plan, in particular it shall include but not be limited to the details outlined in Section 3.10 of the Framework Travel Plan and confirm the Travel Plan Coordinator responsible for the development. Reason: In the interests of promoting sustainable transport to and from the development, in accordance with Policy LP13 of the Peterborough Local Plan (2019).
  11. C10 Prior to the first occupation of the building hereby permitted, details of the cycle stores within each building including the Mill shall be submitted to and agreed in writing with the Local Planning Authority. The cycle parking within each store needs to accord with LTN 1/20 and set out clearly the number of cycle parking space secured. The cycle stores must be set out in accordance with the approved details prior to the first occupation of the building it serves and must be maintained as such thereafter for perpetuity. Reason: In the interest to encourage sustainable travel methods, in accordance with Policy LP13 of the Peterborough Local Plan (2019).
  12. C11 The ‘Office’ use hereby permitted on the Ground Floor of the Mill, shown on drawing 2850-DTA-XX-00-DR-A-1150 Revision P01, shall only be used for purposes within Class E(c) or E(g) only and for no other purpose. Reason: In the interest of future occupier amenity and to ensure sufficient car parking is secured, in accordance with Policies LP17 and LP13 of the Peterborough Local Plan (2019).
  13. C12 Forward visibility of 20m as shown on Drawing 0411-JCE-00-SI-DR-C-9600-P06 shall be provided on the inside of the bend of the access road, adjacent to Building 3, and the inside of the bend of Bittern Way, adjacent to Sand Martin House. The 20m shall be measured to and from the centrepoint of the lane measured between channel line and the centreline of the carriageway. This area must thereafter be retained clear of any obstruction over a height of 600mm above carriageway (shared-surface) level. Prior to first occupation of any residential use hereby permitted, the vehicular access shall be laid out and completed in accordance with Drawing 0411-JCE-00-SI-DR-C-9600-P06 and retained in perpetuity. All parking bays which are not initially EV Charging bays must be installed with ducting to enable easy future conversion to EV Charging bays as required. Reason: In the interest of highway safety, in accordance with Policy LP13 of the Peterborough Local Plan (2019) and Paragraph 116 of the National Planning Policy Framework 2024.
  14. C13 Prior to first occupation the sustainable drainage scheme shall be laid out and maintained in accordance with the following documents: - Drainage Technical Note DR-REP-0411 Revision 01 (received 16/04/2026) - Drainage GA 0411-JCE-00-SI-DR-C-3000 Rev P02 - Drainage Exceedence Plan 0411-JCE-00-SI-DR-C-3020 Revision P01 - Combined Drainage and Levels GA 0411-JCE-00-SI-DR-C-3090 Revision P01 - Drainage Maintenance Plan ref 0411-DMP Revision 00 Reason: To prevent the increased risk of flooding and to improve and protect water quality, in accordance with policy LP32 of the Peterborough Local Plan (2019) and Chapter 14 of the NPPF (2024).
  15. C14 The development shall be carried out in accordance with the submitted flood risk assessment (FRA) (ref 163822-F01 Rev A, dated 25 August 2023, compiled by Ashfield Flood Risk Solutions/ FPS Environmental) and the Proposed Site Plan (ref 2849-DTA-XX-XX-DR-A-0350 P02, dated 14 May 2026) and the following mitigation measures they detail: • Finished floor levels of the two self-contained ground floor flats within the Whitworth Mill Building shall be set no lower than 5.740 metres above Ordnance Datum (AOD) in accordance with the Proposed Site Plan (ref 2849-DTA-XX-XX-DR-A-0350 P02, dated 14 May 2026). • Finished floor levels of Buildings 1 – 3 shall be set no lower than 5.740 metres above Ordnance Datum (AOD) in accordance with the submitted FRA (ref 163822-F01 Rev A, dated 25 August 2023) and Proposed Site Plan (ref 2849-DTA-XX-XX-DR-A-0350 P02, dated 14 May 2026). These mitigation measures shall be fully implemented prior to occupation and subsequently in accordance with the scheme’s timing/phasing arrangements. The measures detailed above shall be retained and maintained thereafter throughout the lifetime of the development. Reason: To reduce the risk of flooding to the proposed development and future occupants.
  16. C15 All apartments located along the elevations will be fitted with high-performance windows incorporating glazing capable of achieving a minimum sound reduction index of 41dB. Any wall orifices must be of specification cumulative Dne,w 38 dB or higher. Reason: To ensure appropriate future occupier amenity standards in accordance with Policy LP17 of the Peterborough Local Plan (2019).
  17. C16 All ventilation of steam and cooking fumes to the atmosphere shall be suitably filtered to avoid nuisance from smell, grease or smoke to persons in neighbouring or nearby properties. Prior to installation the details of the nature and location of such filtration equipment as well as details of the proposed Sound Power Level (SWL) and frequency spectrum data for mechanical extract ventilation shall be submitted to and agreed in writing by the Local Planning Authority. The approved equipment shall be implemented prior to the Restaurant/Café uses first commence. Thereafter the approved equipment shall be retained and maintained in perpetuity. Reason: In the interest of protecting the amenity of neighbouring residents, in accordance with Policy LP17 of the Adopted Local Plan.
  18. C17 Prior to installation and operation details of the make, model, location, sound power level and frequency spectrum data of any mechanical plant shall be submitted to and approved in writing by the Local Planning Authority. The information will be required to demonstrate that the noise rating level from the operation of the mechanical plant does not exceed 40dB LAeq,15 minutes. The noise levels should be determined at the nearest noise sensitive premises. The measurements and assessment should be made according to BS:4142:2014. Thereafter the development shall be implemented in accordance with the approved details, including any necessary mitigation, and shall thereafter be retained and maintained as such in perpetuity. Reason: In the interest of future occupier amenity within the residential units in accordance with Policy LP17 of the Peterborough Local Plan (2019).
  19. C18 On completion of measures identified in the approved remediation scheme (set out within Section 5.4 of the Phase II Geo-Environmental Assessment) and prior to occupation of any part of the development, a validation report (that demonstrates the effectiveness of the remediation carried out) must be submitted to and agreed in writing by the Local Planning Authority. Reason: To provide verification that the required remediation has been carried out to appropriate standards, in accordance with Policy LP33 of the Peterborough Local Plan (2019) and the provisions of the National Planning Policy Framework (2025).
  20. C19 If, during development, contamination not previously considered is identified, then the Local Planning Authority shall be notified immediately, and no further work shall be carried out until a method statement detailing a scheme for dealing with the suspect contamination has been submitted to and agreed in writing with the Local Planning Authority. The development shall thereafter not be carried out except in complete accordance with the approved scheme. Reason: To ensure all contamination within the site is dealt with, in accordance with Policy LP33 of the Peterborough Local Plan (2019) and paragraph 189 of the National Planning Policy Framework (2024).
  21. C20 Notwithstanding the approved plans, the lighting scheme shall not exceed the obtrusive light limits specified for environmental zone E2 in the Institution of Lighting Professionals document ''Guidance Note 01:21, The Reduction of Obtrusive Light''. Further, the lighting scheme shall comply with the recommendations set out in 'ILP PUBLICATIONS Guidance Note 8 Bats and Artificial Lighting' for lighting spectrum to avoid harming the ecology within the River Nene. In the event of any reasonable complaint being received by the Local Planning Authority, the Developer or their successors in Title, shall be required to undertake an assessment to demonstrate compliance with the above lighting limits in the above two Guidance Notes and submit this within 28 days of notice issued by the Local Planning Authority. Should such an assessment fail to demonstrate compliance, further mitigation measures shall be submitted alongside the assessment and implemented in accordance with the submitted details within 28 days of approval by the Local Planning Authority. Reason: In the interest of neighbour amenity in accordance with Policy LP17 of the Peterborough Local Plan (2019).
  22. C21 Notwithstanding the submitted details, prior to the occupation of the development a scheme for hard and soft landscaping of the site shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the following:- - Proposed finished ground and building slab levels - Proposed planting plans including trees, species, numbers, size and density - Hard surfacing materials Any trees to be planted within 4.5m of any adopted Highway features including the carriageway, parking areas and footpath/cycleway, together with any land drainage, including SUDS features, swales and the river bank should be suitably protected against future damage/liability from tree root encroachment/damage, then full tree pit details (sections), with dimensions should be submitted to and approved in writing with the LPA prior to the planting of any such trees. The soft landscaping shall be carried out within the first available planting season following completion of the development or first occupation (whichever is the sooner) or alternatively in accordance with a timetable for landscape implementation which has been approved as part of the submitted landscape scheme. The hard landscaping shall be carried out prior to first occupation of the development hereby permitted. Development shall be carried out in accordance with the submitted details. Any trees, shrubs or hedges forming part of the approved landscaping scheme that die, are removed or become diseased within five years of the implementation of the landscaping scheme shall be replaced during the next available planting season by the developers, or their successors in title with an equivalent size, number and species to those being replaced. Any replacement trees, shrubs or hedgerows dying within five years of planting shall themselves be replaced with an equivalent size, number and species. Reason: In the interests of visual amenity of the area and the enhancement of biodiversity, in accordance with Policies LP16, LP28 and LP29 of the Peterborough Local Plan (2019) and Chapter 15 of the National Planning Policy Framework (2024).
  23. C22 Notwithstanding the provisions of Class A, Part 2, Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no fences, gates, walls or any means of enclosure shall be erected within the curtilage of the entire development hereby permitted, unless expressly authorised by any future planning permission. Reason: In order to protect and safeguard the amenity of the area, in accordance with Policy LP16 of the Peterborough Local Plan (2019).
