Having considered the submitted information, and the information contained within the Council's own records, there are no records of the application site having a lawful change of use to a farm shop nor its revert back to agricultural use. Given the context of the site, the location of this building in context with the wider site and appearance of the building, it is probable that the site could have been the previous farm shop on a small ancillary level. As described under planning reference 18/01960/FUL, there was a farm shop within this area of Moor Farm, which was in operation for 11 years prior to the granting of permission of the new farm shop and cafe in its present location, however, there is no information on which building the farm shop previously operated in. Having considered the information available, on the balance of probability, the existing development as shown on the submitted plans, the building layout and the supporting information provided, it is likely that the site was a small ancillary farm shop which has been reverted back to agricultural use since 2021 as per the applicant's statement. In accordance with Section 191 of the Town and Country Planning Act 1990 (as amended) the Local Planning Authority should issue a Certificate of Lawfulness of Existing Development to confirm this building is agricultural use. The existing agricultural use is therefore lawful.
