Condition 13: Partially Discharged Prior to the commencement of development details of existing and proposed site levels including the finished floor levels shall be submitted to and approved in writing by the Local Planning Authority. The plans shall include details of all finished floor levels, levels for associated garages and gardens, details of any earthworks, retaining features and confirmation that level access can be achieved. The development shall thereafter be carried out in accordance with the approved details. The application is only seeking discharge of the parcel of land which is subject to the reserved matters 24/00541/REM and not for the section of the land for the footpath. This will require a further application to discharge this information. This does not contravene the principles of Policy LP40. Eye Parish Council comments have raised an objection to the discharge of the condition. Application 26/00116/NONMAT altered the trigger of Condition 13 to allow for the submission of levels details prior to the commencement of development. It is noted the levels details are revised to respond to the surface water drainage strategy. Officers note the changes to the levels (reduction and increase) across the site to be able to deliver a gravity fed surface water drainage system. A key area is the southern boundary of rear curtilages for plots 16-59 which will include a retaining structure of varying heights and building materials. Where there may be changes to the levels of boundary plots, these are all considered to be acceptable to still maintain an acceptable amenity relationship with existing occupiers or neighbouring properties. Furthermore, the level changes across the site are not considered to result in harm to the street scenes across the development and where retaining features are used these have been sympathetically placed to minimise any visual intrusion to on and off site visibility. The Lead Local Flood Authority has observed that site levels were adjusted to accommodate the updated surface water drainage plan. The previous strategy involved a pumped system whereas sustainable drainage schemes should aim to mimic natural greenfield runoff patterns through a gravity-based system. The LLFA have worked closely with the developer and the LHA when reviewing the levels across the site. By changing the drainage to a gravity-based system, it resulted in areas of land being raised which had an impact on how the roads, houses, gardens and adjacent ditches interacted with one another. This proposal has resulted in the requirement for a small retaining wall to be positioned along the southern boundary of the site before the ditch on the southern boundary. The LLFA did raise concerns regarding the ownership of the retaining wall and what impacts it could have on surface water management if the wall was not maintained. To overcome this within Section 11 Southern Ditch Retaining Wall of the Drainage Maintenance and Management February 2026 Rev C; states in section 11.5 that ''the retaining wall feature and it’s maintenance will be retained by the management company, and the maintenance, repair, ownership and upkeep of this feature will be the management company’s responsibility in full.'' This is acceptable to the LLFA. The Local Highway Authority have no objections. It should be noted that where drawings split the site into phase 1 & Phase 2, this is not approved under this application and nor directly relation to the phasing of the development. Conclusion: The details submitted relating to condition 13 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition for the parcel submission. Condition 13 is hereby partially discharged, subject to implementation in accordance with the approved details.
  2. Condition 15: Partially Discharged Prior to the commencement of development (other than ecological investigation and surveys), a detailed scheme of the design, implementation, maintenance and management of the sustainable drainage scheme based on the approved preliminary SWS Drainage Strategy shall be submitted to, and approved in writing by, the Local Planning Authority. Those details shall include, but are not limited to: - A full and up to date sustainable drainage strategy and plan; - Information about the design storm period and intensity, discharge rates and volumes (both pre and post development), temporary storage facilities, means of access for maintenance, the methods employed to delay and control the surface water discharged rom the site and the measures taken to prevent flooding and pollution of the receiving groundwater and/or surface waters; - Any works required off-site to ensure adequate discharge of surface water without causing flooding or pollution (which should include refurbishment of existing culverts and headwalls or removal of unused culverts where relevant); - Construction/technical details of all drainage assets; - Hydraulic calculations; - Overland flood flow and exceedance routes, both on and off site; - A timetable for its implementation; - Maintenance and management schedules for all drainage assets, which includes details of the parties responsible for said maintenance throughout its lifetime. Consideration needs to be given to the access for maintenance for all drainage assets, which includes but is not limited to the wetland ponds and outfalls; and - Demonstration that it meets the government's national standards. The development shall thereafter be carried out in accordance with the approved details before the dwelling to which it relates is first occupied. Reason: To prevent the increased risk of flooding, to improve and protect water quality, improve habitat and amenity, and ensure future maintenance of the surface water drainage system, in accordance with Policy LP32 of the Peterborough Local Plan (2019). The drainage strategy is a gravity-based system which involves a series of highway swales, rain gardens and highway gullies which discharge into two attenuation basins within the site. Attenuation basin 1 is restricted to a rate of 10 l/s and attenuation basin 2 is restricted to a rate of 5.5 l/s. These are restricted to greenfield run off and therefore acceptable to the LLFA. It is also noted that the North Level IDB have no objections to the proposed discharge rates and drainage strategy. A land drain which runs along the northwestern boundary of the site is proposed to be filled with a French drain which will enable infiltration and water from the sports fields to be directed around the western boundary of the site before discharging into the ditch along the southern boundary. Suitable maintenance strips are provided and therefore this is acceptable to the LLFA. Alterations are proposed to the ditch along the southern boundary. This involves deepening the ditch and providing side slopes of 1 in 1.5. Whilst the LLFA would usually recommend a side slope of 1 in 3 for maintenance, the area will be managed by a management company. The developer and management company therefore have confirmed that they are content with the proposed bank and maintenance strip. This is acceptable to the LLFA. The LLFA note that the exceedance flows have been provided on drawing ST-3716 550 Rev A Exceedance Routes. In the previous response the LLFA raised concerns regarding the exceedance flow routes and requested that these be amended to ensure water is held within the site during the exceedance periods. The LLFA note that the drainage calculations demonstrate that the peak flows for the 1 in 100 year + 40% climate change events, that the storm are contained within the network and there is no flooding outside the system. Therefore, any exceedance flows will be minimal. The LLFA note that some flows have been amended marginally to ensure these are redirected towards on the onsite ponds. This is now acceptable to the LLFA. The timetable for implementation has been provided in Surface Water Implementation Timetable February 2026 Rev A. This document details how the suds ponds 1 and 2 will be delivered in terms of occupation of the site. For the site set up Section 2.5 details that the suds pond 1 will be excavated in month 1-6 to provide drainage for the site during construction. This is acceptable to the LLFA as will provide attenuation suitable for the development during the construction period. This will enable water to be filtered before discharging off site. The management and maintenance of the suds system has been provided in Drainage Maintenance and Management February 2026 Rev C. This provided details for how the development drainage system will be managed during, 1 year and post completion. This provided details relating to the various elements of the drainage strategy including the swales, rain gardens, filter strips and retaining wall. This is acceptable to the LLFA. A conveyance plan has been provided within this document identifying which sections of land will be passed to the management company such as the filter strip and retaining wall/ditch along the southern boundary. This is acceptable to the LLFA. Furthermore the Internal Drainage Board raise no objections to the scheme. As per the discharge of Condition 6 (25/01171/DISCHG) the phasing of the drainage system is to be discharged under this condition. The technical drawings and Implementation Timetable illustrate the sub-division of the development into two sites and split by the IDB central drain. This is acceptable to the LLFA & LPA. Key drainage features such as the ditches and the SUDs ponds have their own individual implementation triggers, which are also acceptable. It should be noted that SUDs Pond 2 has differing triggers for delivery in the document, following confirmation from the developer, the delivery of SUDs Pond 2 must be before the first occupation of Phase 4 & 5. Furthermore, the delivery of the french drain will be installed and connected prior to any occupation of plots 115-139 (the plots that connect into the french drain). Conclusion: The details submitted relating to condition 15 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition for the parcel submission. Condition 15 is hereby partially discharged, subject to implementation in accordance with the approved details.
  3. Condition 16: Partially Discharged Prior to the commencement of development (excluding site clearance works), a detailed scheme of foul drainage including details of any phasing or off-site connections/ infrastructure improvements shall be submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details before the dwelling to which it relates is first occupied. Reason: In order to ensure that the site can be adequately drained, in accordance with Policy LP32 of the Peterborough Local Plan (2019). This is a pre-commencement condition as the foul drainage needs to be agreed at the outset of the development. The application is only seeking discharge of the parcel of land which is subject to the reserved matters 24/00541/REM and not for the section of the land for the footpath. This will require a further application to discharge this information. This does not contravene the principles of Policy LP40. Eye Parish Council comments have raised an objection to the discharge of the condition. Anglian Water have reviewed the information and find the details outlined in ST-3716 511-D/ST-3716 510-D acceptable. Conclusion: The details submitted relating to condition 16 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition for the parcel submission. Condition 16 is hereby partially discharged, subject to implementation in accordance with the approved details.
