Planning conditions
  1. Condition 3 (External Materials) Prior to the first construction of the bridge hereby approved, all external materials of the bridge (including but not limited to the deck, handrails/balustrade and soffit details) shall be provided including colour finishes and agreed in writing with the LPA. The proposal shall thereafter be implemented in accordance with the approved scheme. Reason: To secure an appropriate external finish for the proposal in accordance with Policies LP16 and LP19 of the Peterborough Local Plan (2019). Plans and documents submitted in support of the discharge of C3: - J25125_DES_ALL (Foundations) (P01) (20_10_25) - J25125_DES_ALL (Superstructure) (P01) (16_10_25) - RAL 9002 Grey white (RAL Classic) _RALcolorchart.com - screenshot-1768220391741 Assessment: Having reviewed the submitted plan, the Officer agrees that the proposed details are acceptable and are in line with the Council's Local Plan policy LP16. As such, the detail submitted is deemed acceptable for the Local Planning Authority to discharge the condition. Conclusion: The details submitted relating to condition 3 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition. Condition 3 is hereby discharged, subject to implementation in accordance with the approved details.
  2. Condition 8 (Lighting design strategy for biodiversity) No external lighting shall be erected until, a "lighting design strategy for biodiversity" for all lighting across the site shall be submitted to and approved in writing by the local planning authority. The strategy shall: a) identify those areas/features on site that are particularly sensitive for ecological constraints that are likely to cause disturbance in or around their breeding sites and resting places or along important routes used to access key areas of their territory, for example, for foraging; and b) show how and where external lighting will be installed (through the provision of appropriate lighting contour plans and technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent the above species using their territory or having access to their breeding sites and resting places. c) provide a mitigation plan that details how the lighting will be controlled (times and dates the lighting is used, frequences and lux levels during those times, Etc.) to minimise the impact on the known existing bat and other nocturnal animal populations present within the area, or those that may be using the area as a commuting corridor. All external lighting shall be installed in accordance with the specifications and locations set out in the strategy, and these shall be maintained thereafter in accordance with the strategy. Under no circumstances should any other external lighting be installed without prior consent from the local planning authority. Reason: To ensure that the recommended mitigation and compensation is delivered with the scheme to protect biodiversity and Policy LP28 of the Peterborough Local Plan 2019 and Chapter 15 of the National Planning Policy Framework 2024. Assessment: Having reviewed the submitted plan, the Officer agrees with Wildlife Officer that the proposed details are not acceptable as such, the detail submitted is not deemed acceptable for the Local Planning Authority to discharge the condition. Conclusion: Condition 8 is not hereby discharged, and a further application is required to address this condition.
  3. C13 (surface water drainage scheme) Prior to the commencement of development, a detailed surface water drainage scheme for the site, based on sustainable drainage principles and an assessment of the hydrological and hydro geological context of the development, must be submitted to and approved in writing by the Local Planning Authority. The scheme should include but not be limited to: o Verification of the suitability of infiltration of surface water for the development. This should be based on infiltration tests that have been undertaken in accordance with BRE 365 testing procedure and the infiltration testing methods found in chapter 25.3 of The CIRIA SuDS Manual C753. o Longitudinal and cross section details of drainage systems. This could include pipe inverts, dimensions and slopes. o The slope of the deck towards either banks o Final modelling and calculations for all areas of the drainage system. o The appropriate level of treatment for all runoff leaving the site, in line with the Simple Index Approach in chapter 26 of the CIRIA SuDS Manual C753. o Detailed engineering drawings of each component of the drainage scheme. o A final drainage plan which details exceedance and conveyance routes and directions of overland flows at the banks and location, size and gradient of any drainage features. o A written report summarising the final strategy and highlighting any minor changes to the approved strategy. Reason: To prevent the increased risk of flooding and to improve and protect water quality, in accordance with policy LP32 of the Peterborough Local Plan 2019 and Chapter 14 of the National Planning Policy Framework 2023. The condition is pre-commencement as it would be unreasonable to require applicants to undertake this work prior to consent being granted and the details need to be agreed before construction begins. Plans and documents submitted in support of the discharge of C13: - Cygnet Bridge – Drainage Design Statement March 2024 Assessment: Having reviewed the submitted plan, the Officer agrees with the revised LLFA comments that the proposed details are acceptable and are in line with the Council's Local Plan policy LP32. As such, the detail submitted is deemed acceptable for the Local Planning Authority to discharge the condition. Conclusion: The details submitted relating to condition 13 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition. Condition 13 is hereby discharged, subject to implementation in accordance with the approved details.
